5 <br /> There being no Cormission or public comment, the Chairman <br /> entertained a motion. <br /> MOT N.- Carole Moore made a motion to continue the Tearing <br /> in this matter to February 1 , 2002 at 7 :20 p. . , at Applicant' s <br /> request; which Motion was seconded by Michael Talbot and so voted <br /> unanimously. <br /> . Clerical Union objection - Mr. Sherman reported the <br /> Clerical Union has filed a formal objection regarding the hiring <br /> replacement of Mrs. Lund. Allegations have been made that at the <br /> time changes were made to the job description, the Union should <br /> have been consulted. <br /> Nor. Sherman argued the Town has always reserved the right to <br /> make changes. Said change consists of language expressing a <br /> preference towards someone with actual wetland. experience. <br /> Town Counsel is reviewing the natter; their initial reaction <br /> being the grievance has no bass.s in fact. An official <br /> determination should be forthcoming very soon. <br /> In the meanwhile the .interviewing process continues with the <br /> hope of hiring someone as soon as possible. Five candidates <br /> were interviewed earlier this week, some of which are very <br /> promising. <br /> Mr. Sherman read the following into the Record: this you are <br /> aware, the positions covered by the Bargaining Agreement between <br /> the Town and Local 254 which states 'The Town recognizes the <br /> Union as the exclusive bargaining agent for the purpose of <br /> establishing wages, hours, and other terms and conditions of <br /> employment. Therefore, any changes of a position must be <br /> negotiated with the Union. , It is our belief that some changes <br /> that significantly alter work conditions for said position were <br /> made without notifying the union. You have violated Article I of <br /> the Agreement initially believed that minimum requirements have <br /> precluded unit members from applying. we respectfully request <br /> that you immediately halt any action you have taken regarding <br /> this job posting, return the job description to its original <br /> format and repast the position. ,, <br /> Mr. Sherman reported there were no applications from this <br /> unit. <br /> r.
