S <br /> Diane explained she met with the applicant's representative and they are making a good faith <br /> effort to address.the Concessions concerns. <br /> Stephanie made a motion to continue the Smith hearing to August 'at 7:0 p.m. Len <br /> seconded the motion. All members were in favor 4-0 <br /> OTHER ITEMS <br /> Diane explained she was notified of a violation at 132 Waterway; cutting of a naturally vegetated <br /> buffer strip. She found the landscaper at the site who admitted to some cutting. The applicant <br /> has removed vegetation in violation of an existing order of conditions. She is asking the <br /> Commission to ratify the enforcement order. Extraordinary efforts were made originally to <br /> salvage the natural material at the site. The cutting was done in an area marked to be enhanced. <br /> Len made a motion to ratify the enforcement order for 132 Waterway and inform them <br /> a restoration plan must be filed no later than Sept 15, 2002. John seconded the <br /> notion. All members were in favor 4-0. <br /> Diane explained she was called to Popponesset beach about a had odor. It was determined the <br /> odor was from decomposing seaweed near Starboard Lane. In the process of walking the beach it <br /> was obvious the beach to the east had been illegally raked by machine. An enforcement letter <br /> has been sent and the applicant is working on filing a notice of intent. <br /> HEARINGS <br /> 7:1 o hearing: James K. and Kathleen Miller, 105 P pponesset Island Road (relocate existing path <br /> and revegette section of path, after the fact) <br /> Peggy explained this•hearing needs to be continued so that a correct legal ad can be run. The <br /> application did not properly list the 3 addresses where the work is being done. <br /> i <br /> Len made a notion to continue the Miller hearing to August 'at 7:40 so that a <br /> correct legal ad can be placed. John seconded the notion. All members were in favor <br /> 4-0 <br /> OLD BUSINESS <br /> Peggy explained at 2 1 2wheeler Road S alaveiro there has been unperitted cutting of trees on <br /> the bank to the pond. She net with the owners and they have dome nothing to comply. Peggy <br /> explained taht the follow p on this matter will be by herself or Bob as agreed to by Joyce <br /> Ikon. She recommended another enforcement order be issued for unpermitted cutting of trees, <br /> nperitted clearing of vegetation.and failure to comply with an enforcement order of Sept. <br /> 2001. Further, the Enforcement Order will inform the owners that they rust file a notice of intent <br /> no later than August 23'. Failure to file will result in a show cause hearing which will be <br /> scheduled before Commission in September.. <br /> Peggy said these are serious violations and the owners are making no plans to address them. <br /> There has been more cutting dome this year (since the enforcement order of Sept. 2001). <br /> Elliot asked if they can be f'med <br /> Peggy said that will be the next step.
