been recent removal of growth -- specifically, a mixture of bayberry, blueberry, <br /> sassafras, for a total of 12 plants at rear of the house. <br /> Motion made, seconded and unanimously carried to grant a negative determination <br /> with the understanding that there will be a revised plan filed indicating plantings as <br /> stated above. <br /> 7:10 p.m. Frederic Blythe, 228 Wading Place Road (continued from 8/22). <br /> No one was present to represent the applicant. Bob stated that the applicant has not <br /> directed John Slainsly to hire the requisite expert vire feel needed ander Section 12 of <br /> the Biological Guide because there is evidence that the shore line has roved. <br /> Elliot stated there have now been eight continuances. <br /> ,John Slavinsky was invited to join the meeting. He said what's needed is someone who <br /> is versed in the possibility of the wetland zone being changed. Elliot asked John if h <br /> is correct in recollecting that at a previous hearing, a request was made that the <br /> applicant commit to the appointment of an independent expert as a condition. John <br /> agreed that was so. John said he obtained an estimated fee to do it, which he thought <br /> was fairly reasonable, but he got no approval to proceed. <br /> Bob clarified that if Jhn, on behalf of his client, did not withdraw the application# the <br /> Commission would have to deny it; that he could request a withdrawal temporally with <br /> the right to reapply and with the understanding that we still need that expert opinion. <br /> Elliot stated that the applicant requested to withdraw the application. `here being no <br /> dissent, the withdrawal was granted. <br /> 7:15 p.m. Elliot Rosenberg, 17 Pontiac Road (construct and maintain driveway and <br /> carport) Because this was Elliot's application, he was not eligible to vote on it. <br /> Therefore, in order to have a quorum, he nominated Stephanie Jones to vote as a <br /> Commissioner on this issue. <br /> Bob reported that he has inspected the proposed project and it definitely falls within our <br /> allowable standards, and he recommended approval. <br /> Lotion Made, seconded and unanimously carried to grant a Negative 2 Determination. <br /> 7:20 p.m. Andy Donellon, 17 & 21 santuit Lane (construct a shed). Mr. Donell on was <br /> present. Bob reported that Diane recommended approval of this project with the <br /> stipulation that the witchha el bush is to remain and that there be no removal of <br /> vegetation to build the shed. Mr. Donellon agreed to this stipulation and added it to <br /> the application with his signature and date. <br /> Motion made, seconded and unanimously carried to grant a Negative 3 Determination <br /> with the conditions that the plan be altered as recommended above. <br />
