Town's By-Laws. Joe Malley represented applicant along with John Vaccarol, Environmental Consulting, and David Thulin, engineer. Mr. Malley said the site had some contaminations} but they cleaned these up and got a clean bill of health from the State. Bob said vire don't have the required notification that applications have been filed with the various agencies and therefore vire should continue it to a future meeting. Diane said there was a meeting in August with Town Counsel in which he explained the normal process for a 408 application. Le., the input from the Planning Board, the Building Department and the Board of Health is given tQ the Board of Appeals, and then the applicant comes before the Conservation Commission. Bob thought that we needed to get clarification from Tran Counsel as to whether we can issue a permit before the applicant applies to the Board of Appeals. The Charman asked for any other comments, and Diane said the applicant has agreed to leave the majority of the river front in its natural state and to revise the grading so that it would be preserved. Diane pointed out that there were some previously altered areas and the applicant is taking out an asphalt driveway and some other debris. She recommended approval subject to 1 approval of a revised plan incorporating the river front issues, and 2 Torn Counsel's opinion about the application to and approval of the Conservation Commission prior to application to the Board of Appeals. Rich Green# 137 Meetinghouse Road, asked if the Board has looked into the impact of additional nitrogen that will be introduced to the river. Diane said the septic systems are not located in an area that is under the jurisdiction of this Commission. Jesse Littledoe Fermino, 21 Meetinghouse load, raised issue about 12 houses being built on site where there should only be two. Jack said this Commission has no jurisdiction on that matter. She then raised issue that she has seen buildings removed, bulldozed over and grading done, but has not seen any comprehensive testing done. Jack said this Commission has no jurisdiction over those issues, that she should direct them to the Board of Health. Wilfred Morris, Plymouth,mouth, asked about ghat was removed from property.
