i <br /> Motion made, seconded and unanimously carried to mirror the State fees under a local <br /> by-law. <br /> Merin Agenda <br /> 7:00 p.m, Phillip King, 180 Fells Pond Road vegetation control, removal of timber <br /> steps and replace with stone, construct deck). Bob Gray, Sabatia Inc., represented the <br /> applicant. He requested that the Commission monitor the revegetati n a year from <br /> now, and not require supplemental replantings at this time. Diane said they are just <br /> asking for maintenance of an existing pathway that got enlarged illegally, but since we <br /> allow this regularly for a foot path, there is no problem with that. <br /> Diane said that the deck Is an Issue because it is in the bank, and she has a problem <br /> with the adjacent deck which was probably In an area that was BVW and was cleared. <br /> Jack said the proposed work goes against the vista pruning policy, and the fact that <br /> neighbors have a deck that was erected years ago has no bearing on this project under <br /> the current rules. However,, he said that the applicant could put a deck on the pond. <br /> Mr. Gray requested a continuance to present an amended plan which would place the <br /> deck on the pond,, and he will readvertise. <br /> Motion made, seconded and unanimously carried to approve the applicant's request <br /> for a continuance to November 7 at :30 p.m., with the requirement that the applicant <br /> readvertlse. <br /> 7:05 p.m. Louis Dimeo, 75 Popponesset Island Road (maintenance in perpetuity for <br /> existing dock). Bob recommended approval. <br /> o#ion made, seconded and unanimously carried to approve a Negative 2 <br /> Determination. <br /> 7:10 p.m., Bernard Pernstein, '161 Daniel's Island road (continued from 10/3). <br /> Bob stated that the landscaper has still not contacted the applicant. Elliot said there <br /> have been three or four continuances on this application and he moved positive. Bob <br /> recommended a motion that the applicant can withdraw the application and resubmit or <br /> we will move positive on it. <br /> Motion made, seconded and unanimously carried to allow the applicant to withdraw the <br /> application and resubmit; otherwise he gets a positive determination. <br /> 7:15 p,m , Robert Pinelli, 135 Surf Drive (add sunroorn to existing deck). Bob <br /> recommended approval pending confirmation that they have submitted the plan to <br /> the Board of Health. <br /> 5 <br />
