Bob said he spoke to the Shellfish Marden and the Harbormaster, who have no <br /> problem with approving a 5 horsepower boat, and he recommends approval. <br /> Motion made, seconded and unanimously carried to close the application. <br /> 7:20 p,m., Michael Corwin,, 142 Fells Pond Road (maintain stairway, handrail, ramp <br /> and float). Brad Holmes of the BSC Group represented the applicant and presented <br /> the plan, which included an after-the-fact walkway and three attached floats. <br /> Jack said this is not a great pend and Perry EIlis has no jurisdiction of Vit. <br /> Mr. Holmes presented a study from the DEP listing great ponds and he said it's true <br /> that t=ells Pond is not listed as a great pond. However, he said that Perry Ellis sant <br /> down with the Town Planner and the GIS shored it was greater than 10 acres, so <br /> there"s a conflict there. <br /> Bob said Perry may have no jurisdiction under Chapter 9 1, 1 o- , but he still may have <br /> local jurisdiction, and that's something we have to sort out. Bob said he also talked to <br /> the Building Inspector and 'It 's not legally clear as to whether or not the Board of <br /> Appeals permit is involved. Bob said it's probably not. <br /> Jack said IIIb. olme's input has no relevance on this application. Bob said it does <br /> have relevance because if it turns out legally he does have local permitting authority, <br /> then thisp ermit application is not complete under the Web n d s Act, but other permits <br /> are applicable. <br /> "here was considerable discussion about the three attached floats — i.e.# human and <br /> wildlife passage along the shore line, a landing, placement of anchor. <br /> Elliot asked about winter storage of the floats, and Mr. Holmes said they can easily be <br /> carried onto the land. <br /> Jack expressed concern that the floats be constructed of new material, and Bob said <br /> vire can condition that. <br /> Mrs. Champion, neighbor, expressed concern about how far out the floats would be. <br /> The applicant said the proposed float is 7 ft. closer to the shore than the existing one. <br /> John Schvartbaugh# 120 Fells Pond load, said the existing float is illegal because no <br /> notice wasgiven to the abutters, it was already further out than ars other dock in the <br /> area, and this plan proposes to male this whole area Corrin area rather than the Fells <br /> Pond area. <br /> 4 <br />
