He explained that the <br /> hearing had been continued from March 6, 2008, until Natural Heritage could be heard back from. Natural <br /> Heritage did respond and had no concerns about the project. The Agent stated that the Natural Heritage <br /> response was all he was waking for and recommended approval. He explained that the landscape plans <br /> for this project are quite unique and while pools are not normally seem as a.necessity,the bylaws do <br /> allow for approval with mitigation. The Agent Mated that Mr. Talbot and Mr. Slavinsky have gone above <br /> and beyond as far as mitigation and he hopes more landscape designs like this can be adopted in the <br /> Town. <br /> Motion made#seconded and una.nirnously carried to close and Issue. <br /> 7:03 Christopher Peacock, NON—7 crow Ind <br /> (Seasonal dock, retaining wall, vista pruning) <br /> The Agent stated that the applicant had requested a continuance until 05/01/08 @ :12 p.m. <br /> Motion made,seconded and unanimously carried for a continuance until 0510112008 @ 7:12 p.m. <br /> 7:05 p.m. Richard scaio, RDA—389 Mo omoscoy(Fence) <br /> Mr. Scalo stood to describe his request. He explained that he wishes to.install.a fence in the northerly <br /> boundary of his property. The fence will be ' high and constructed out of 1#x 4 . He went on to explain <br /> that he would like to install the fence as the new construction next door is very close to his property and <br /> faces his front door. He stated that he wants to prevent encroachment and regain some privacy.The <br /> Agent explained to the Commission that the fence would be 'from Little Fiver and though it will t <br /> long it should cause no impact in the area. The Agent did ask the applicant to make sure there is a 6" <br /> clearance on the bottom of the fence to the ground, the applicant agreed to that request. The Agent <br /> recommended approval. <br /> Motion made, seconded and unanimously.carried for a Negative Determination. <br /> 7:09 p.m. Bayswater Development, RDA—94 shore Drive West <br /> (Replace septics with gander pumps,tie into existing treatment plant) <br /> (Cass costa recuses herself) <br /> . Dan Buckley of Baywater Development stood to describe the request. Mr. Buckley explained that they <br /> wish to remove two septic systems, add in the gander pumps and tie therm into their sewage treatment <br /> plant. The Commission asked Mr. Buckley if the system was at capacity yet and could support these two <br /> being added. Mr. Buckley explained that they are tar from capacity on the system. Commissioner Allen <br /> questioned the disturbance removing the septic systems would create to the landscape and what size <br /> pumps/pipes would be required for grinders. Mr. Buckley explained that they would not be set any deeper <br /> than the septic systems are now and the same size pipe main will be used. The Agent explained that it <br /> will cause minimal impact as the area is predi turbed and they will be very conscience he believes. The <br /> Agent recommended approval of the project. <br /> Motion made, seconded and unanimously carried for a Negative Deteirmination. <br /> :12 p.m. Gerald Fine, ICDA—12 summersea <br /> (remove nuisance vegetation, pitch pines) <br /> The hearing was called and no representation stood for Mr. Fine. The Agent explained he had met with <br /> Tom O'Hara about the filing and was not sure why no representation was present. The Agent and <br /> -Commissioners agreed that the hearing should be continued at request of the applicant due to no <br /> representation being present until 05/01/2008 a@ 7:18 p.m. <br /> 2 <br />
