Mashpee Zoning <br /> Board of Appeals Minutes August 13, 2003 <br /> Janice Lundgren:ren: Requests a Special Permit under Section 174-17 of the ZoningBy- <br /> laws to expand a pre-existing non-conforming structure to allow for construction of a <br /> new roofed entry deck and steps on property located in a -3 zoning district at 12 Cross <br /> Tree way Map 112 Parcel 21 Mashpee, MA. <br /> Sitting: Zella Elizenberry, Richard Guerrera and Marshall Brenn. <br /> Anthony Ferragamo, Architect, represents the petitioner in this hearing. They are seeking <br /> to alter a pre-existing, non-conforming structure and rebuild a slightly larger structure. <br /> They are seeping a 7.7-foot variance in order to add a new roofed entry-deep and steps, <br /> which would infringe on the current setback requirements. The Board feels this would be <br /> an improvement to the overall look of the property and fit in better with the <br /> neighborhood. The lot coverage will be 15.2%, a small increase from 14.7% and still <br /> under the maximum o %. Mr. Ferragamo answers some of'the Board's questions and <br /> after some discussion Ir. Brem moves to grant a 7.7-foot variance in the front and a <br /> Special Permit. Zella Elizenberry seconds the motion. All agree. So moved. This is <br /> conditioned upon site plans from Cape & Islands Engineering, dated July 18, 2003, File <br /> No. 1 o9MA, as prepared for Janice Lundgren, and architectural plans from A.E. <br /> Ferragamo, Registered Architect, Mashpee, MA., no. 99-1008, dated.lune 16, 2003. <br /> v- 3-11 o and SP-o3-111 <br /> Eleanor vanaria: Requests a variance under Section 174-31 of the zoning By-laws to <br /> vary the setback requirements and legalize an existing deck on property located in an R-3 <br /> zoning district at 19 Jeep Place clap 118 Parol 11 Mashpee, MA. <br /> Sitting: Robert Felson, Marshall Brenn and Zella Blienberry <br /> Eleanor vanaria represents herself at this hearing. She is here to legalize an existing deck <br /> that was built without a permit.. She did not realize that she needed a permit to build <br /> deep because here was already one there. She is seeking a variance for 3.1 feet on the <br /> easterly side. The Board also discusses the fact that there are other areas of her house <br /> that is infringing on the current zoning requirements. Mr. Brenn moves to grant the <br /> following variances.- <br /> 3.1 <br /> ariances:3.1 feet on the easterly side <br /> - .9 feet on the westerly side <br /> - .2 feet on the northerly side <br /> Zella Elizenberry seconds the motion.
