I 've been thinking very strongly of the possibility and <br /> probability of a guarantee bond established by the developer- for a period <br /> f 20 to 25 errs of water shed damage liahlility, that probably is a pre- <br /> cedence <br /> r - <br /> d n setting thing that doesn't exist today. I 've mentioned t -Coun- <br /> sel <br /> un- <br /> s l and they've said it' s probably something that could be drafted but <br /> would have to coo through the court system to be totally tested as a pre- <br /> cedence setting thine, but it' s something, leased upon what you've told <br /> me tonight that I still have time to pursue because the dif initivs have <br /> not come in for structural lay-out yet and therefore structural layout <br /> will determine density. " <br /> FB: "What we ran into once we began to develop re-charge aruts and the <br /> knowledge was right there that they respected no boundaries, unfortunatel <br /> the water Advisory Group- that was formed subsequent of the 208, has no <br /> legal means with corning up with anything and we were, hoping that some- <br /> thing would come out of the County review committee that was formed to <br /> revise County Regulations ar�d Law and what-riot that would give an avenue <br /> for this sort of thine, " <br /> Mr. wool : "I realize that your hands are somewhat tied, I guess I 'm <br /> looking for some direction to pursue this, I guess at ' this point is to <br /> turn over whatever documentation that I can acquire to the Planning Bd. " <br /> CHL: "we will follow it through with a letter and also to DEQE,' if you' r <br /> going to follow it from your end, I thik it will he a two-pronged , or I <br /> think it will get us a little more attention- on this matter, it can only <br /> do help us it can' t hurt. " <br /> Mr. wool: "We have forwarded letters to DEQE r : watersdg , this just <br /> came back to us and during the past two weeks I 've been a little ill and <br /> I haven' t done anything on it but pursue it within nay immediate group. <br /> We' re turning over some interesting things at - the water Quality Advisory <br /> Group in the Town of Barnstable in the structuring. of the determination <br /> of the re-charge areas and it turns out that one of the things that was <br /> a little fait dismaying in Cotuit was that the area aroung santuit Pend <br /> is as far as they could determine on the Barnstable side pretty much as <br /> it is on the computer model now, but the area around our three primary <br /> ells which is down off samps ns Mill Rd is much larder and much more <br /> elypti al encompassing much more land mass than we orignally thought <br /> based on the old maps that had been generated, and what that means it' s <br /> doing to be. a lot sooner that a plume could get to our well area, now w <br /> are going to have four wells rather than three drawing off of that re- <br /> charge area and the one well that we have downtown by our Main street to li <br /> is a much smaller re-charge area is singularized than we thought it was, <br /> we thought they overlapped, they are saying, now that according to the <br /> new computer model that they do not, so our four hid users are going to <br /> be in it, consequently based upon our expansion program for our next <br /> well which is going to be in a year or so, hell we' re jumping from the <br /> frying pari ,into the f .rand it' s either- that or spend an amount of money <br /> from_ the District to acquire lands and do all the testing and research <br /> to pint in - a whole new well system, we-' re now using information that w <br /> already have, using an area that we already own, consequently there ' s <br /> a lot of economics involved plus I guess we could call it the moral issue <br /> that goes alone with it, I don' t wnat to deal with economics because I <br /> don' t think that economics4 has to be the dictating factor in the water <br /> works, it can' t be because we have a way of life that is unique in this <br /> part of the country and I 'd really hate to- s o that go. down the tube and <br /> wind up. You know I sound like the foresayer of bad tidings but damn it <br /> they've done it in Florida and Lona Island in ares of similiar terrain <br /> I <br />
