Makunas, H. Govoni <br /> Mr , McDonald informed the Board that his neighbors agreed <br /> with his expansion and provided letters in favor of the <br /> construction. No comments were received in opposition. <br /> - ' The Hoard requested that plans be dated by the engineer. <br /> --Friel moved to grant the Special Permit. Mr, Govoni <br /> seconded. All agreed, <br /> Steven R. Ball - Requests a Special Permit under Section <br /> 174-25 . 1 .9 of the Zoning Hy-laws for permission to <br /> reconstruct and maintain an existing dock in an R-3 zoning <br /> district on property located at 53 Amy Brown Road (Map 109 , <br /> Block Mashpee, MA. (Owner of record: Richard E. <br /> Ball) . <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Mr . Ball *explained that the existing dock has been approved <br /> by conservation. M . Friel Moved to grant the Permit. <br /> Govoni seconded. All agreed. <br /> E. Thomas Jones - (Advisement from 11/10193 ) <br /> Attorney dark Gildea represented Mr . .Tones and Tracey Taylor <br /> represented- D . droll, an abutter. Mr. Gildea said they had <br /> tried to have a resolution with Dr , droll . his . Taylor said <br /> Dr. Kroll would be interested if it is a buildable lot, <br /> . Gild-a-a stated that the deeds show the lots were <br /> purchased separately, owner has paid separate taxes for 30 <br /> years, -l.ot is vacant and was buildable , 1990 .in The <br /> Building :inspector was in error in 1990 in stating lot did <br /> not have ,sufficient frontage. Be said all of the lots On <br /> Daniel ' s Island Road had required either special Permits or <br /> Variances . Mr . Friel stated that the road was passable . <br /> Ms , Taylor said Dr. Kroll said he would consider purchasing <br /> the lot if it was buildable, Mr . Makunas said he was <br /> reviewing Town Counsel ' s opinion and Mr . Gildea said it was <br /> the Board of Appeals who should mare the decision. He <br /> referred to Town Counsel ' s question that whether separate <br /> lot protection once acquired may be lost when the owner <br /> acquires an adjoining lot and said that this is open to <br /> various interpretations . He said the lots were purchased a <br /> different times . <br />
