` Board of Health Meeting, October 28 , 1985, Minute
CHL: That kind of let' s you know where we, or at least where I '
standing. F
Mr, Terry: Does that include all of Ashumet Pond?
RFT: Me' re we'retalking of the area that Charlie Buckingham just pointed
out.
CHL: Point out the area Charlie.
CFB: We ' re, this is the area of inference we feel .
CHL: where does our moratorium go
CFB: our moratorium tales in this area (pointed to Horseshoe Bend,
Tri town and the area from Hoopp o l e Rd north of Johns Pond and over to
the first mentioned locale, north of Ashumet Pond) .
CHL: What' s what I think they wanted to see.
CFB : we ' re corning down the town border, we 're going here to the northern
boarder of John' s Pond Estates, along the shoreline to here.
Agent: It' s all of Briarwood.
CFB: Because if you look at the water slope limes from there, they would
be corning at at a right angle and it would indicate that they would be
coning down across this way.
Mr. Terry: so they would intensively come all the way down (the word may
have been potenti.allly, underscored word)
CFB: , Potentially it could', we don't know, . that' s our problt m, we have no
actual location of the plume, if there is a plume, we just have a report
that causes us alarm.
Mr. TEr Is thence any war in our particular- instance - Yat we couldpro-
vide for a more extensive test with regard to the particular water to be
drawn from this lot that would satisfy the Hoard, beyond what the County
Health Department would require?
CFB: I don' t know how the other Board members would think of it, I can
give you my opinion, I would like to tall with Town Counsel and find
just what exactly where our liability stands, in view of the moratorium
and in view of our knowledge, I would suggest that we go that way.
i r. Terry: As I indicated at the outset, we would, based upon advice
given by Town Counsel, we would be willing to enter into some sort of
indemnification agreement or a clause with the Baord of Health, if the
Board so desires.
CHL: I really don't wnat to get into that area until we talk with hire.
CFB: Until we tall with hire, because I think we all have our ideas of
what' s going on there and what dangers it may or may not pose, and im
portantly to us is that we don't allow anything to happen that will en-
danger an occupant in the area.
CHL : our trust is the public health, we can't just you }snow, we sympathize
right now with the young lady but if she ' d give us a little more time, I
think we can give you a little more of an answer.
Mr. Montgoinery: Excuse me, may I ask any idea time wise, I just carne in.
I don't know what I missed, you know.
CFB: Not very much, if you've heard what we 've just been saying, we
should be able to speak with Town Counsel this Thursday, I thin} it' s
of importance enough to. the 'Town and .it certainly important enough to
us and the people involved that we be put- on his agenda during this
Thursday so that we can tall to him and lay it out , how much time it
will tape him to review things and rake up his mind, I can't answer for,
