MINUTES March 27, 1989 4 BOARD of HEALTH <br /> The engineer informed the' Board that placement of the proposed septic <br /> would not affect. the buildability status of the abutting lot because lot size <br /> alone would constrain any construction. <br /> . costa stated a public hearing for this variance request will be <br /> required and abutters are to 'be notified of the hear-i ng date. <br /> APPOINTMENT: R, out co./Cape & Islands, Discussion - septic system, 3 <br /> Falmouth Road. <br /> Mr. Joseph Gomes- and Mr. William Fisler, representing the Robert B. Our <br /> Co. were in attendance, as well as, fir. & Mrs, Fernandez, Construction Mgr. <br /> for Dacey domes dames Killion and john Slavinsky and David San i c i representa- <br /> tives for cape & Islands Surveying firm. <br /> Ir. Greelish questioned representatives from the Robert B. Our Co. if <br /> permeab l e, fill was brought i n. <br /> Nor. Gomes stated there was approximately 135 yards of clean fill brought <br /> in. <br /> Mr. Evans informed the Board the hole was left open approximately 45 min- <br /> utes at which time the ren began shoveling then water gushed out. He stated <br /> once the blockage was opened up the valve opened. <br /> Mr. Fernandez informed the Board the situation has worsened and stated <br /> in viewing the area only natural layers f soil were seen. <br /> Mr. Greelish explained to Mr. Fernandez , i.th the level of expertise <br /> and typo of exploration performed, i t is not possible to determine if fill <br /> was brought in. Fernandez, in speaking with Town counsel it- was <br /> his opinion that this s i tuat i ori ,was., a civil natters+a s the burden of proof lies <br /> with the owner. ` <br /> i <br /> Mr. Slavinsky explained to Mr. Fernandez the procedure for inspecting <br /> installation of a septic system according -to plans. <br /> Mr. Gomes offered to help Mr. Fernandez with the problem-0 <br /> Mr. Sanio i stated at the time he viewed 'the site they dug next to the <br /> existing system and found it to be infailure. ---. He -commented t 'the. sane time <br /> another test hole was dug in the area of the reserve and was noted at that time <br /> there was sufficient distance from the house to property line to install a pri- <br /> mary system and leave a reserve, so that physically you could install a primary, <br /> .maintain an additional reserve, if necessary, remove the two flow diffusors and <br /> reuse them, put the new system 20 feet away from the foundation, go in thepp o- <br /> site direction of the d-bo .and re-install the diffusors. Mr. Sa n i c i stated <br /> the soil in that area o ' he lot is suitable. <br /> Mr. Comes reiterated his earlier comments stating he would help Mr. <br /> Fernandez in the financial aspect of this endeavor. <br />
