P <br /> i <br /> APPOINTMENT:TMENT: dune Daley/Mr. Vandermeer re: Lapio' s Stable and application <br /> for license. <br /> Ms. Daley was in attendance for -this scheduled appointment, fir. Douglas <br /> Boyd, Building Inspector, was also in attendance. <br /> Mfr. costa stated as a member of his family initially filed a complaint <br /> regarding -this issue he will step down from this ratter as he determined this a <br /> conflict of interest. <br /> Mr. McQuaid stated the stable regulations were adopted as a result of <br /> this Boards concerns with stables and complaints received by residents who <br /> abut the stables. Mr. MCQUdid stated a written complaint against the Lapio <br /> barn from Kira Andrade hays been. rece1ved .r.ega.rding_.the dust created by the stables <br /> and commented in speaking with Ms. Vandermeer this morning she indicated she <br /> is diligently working to control the dust by periodic spraying of the corral <br /> area. Mr. McQuaid informed the Board he .net with the Building Inspector and <br /> Town counsel to discuss the issuance of a stable license to the Lapio barn <br /> and commented it was Town counsel 's recommendation that the license is not <br /> issued from this dpartent as the property is in violation of zoning re- <br /> quirements. Mr. McQuaid stated Town counsel was of the opinion that the <br /> applicant be informed that- Special Permit must be obtained from the Zoning <br /> Board of Appeals, which would grandfather the operation, a -Varian e from the <br /> stable regulations is also required, as well as , proof that establishes the <br /> operation as non-commerci 1 , which is a determination that must be rendered <br /> by the Department of Food and Agriculture. fir. McQuaid stated Town counsel <br /> recommended they be given 90 days to pursue administrati e relief, if this <br /> relief is not obtained within that time period this Board should pursue' -.the <br /> issuance of a "Cease and Desist" order to their operation. <br />
