MINUTES ugu st 3, 1989 3 BOARD of HEALTH <br /> Mr McQuaid stated under Title V regulations you must have at least 41 , <br /> from the bottom of the leaching facility, n tural impervious soil to ground <br /> water and- explained that a natural dehydrated pert was not performed however <br /> oils appeared, below ground water elevation,, be medium pert ab 1 e sand. <br /> . Greelish questioned Mr. Slavins y as to whether lot I has been <br /> approached to find some solution to the well . <br /> Nor. slavinsl y stated yes, however variances would still be required. <br /> Mr. Gree l i h stated the Board of Health' s primary concern is the contam- <br /> ination, of the existing wells. <br /> Mr. slainky stated the existing well is less then 10 ' feet. <br /> Mr. Gree l i h Commented -the existing system will probably expire within <br /> the next few years, <br /> Mr. Slavinsky explained t the Board that if the system were to be p l aced <br /> in the front it wou i d extend into Shore Drive.. <br /> Mr. Gree l i sh re i terated-_ h i:s- earlier comments stating we would like to <br /> see some negotiations made between the owners of lot 1 and lot 2 regarding <br /> the water source. <br /> Mr. Costa questioned.-owners- oflot 8 as to whether they object to ' lie <br /> proposed location of the- system and the -variances requested. <br /> Mr. Bettencourt responded that he does object to the placement of the <br /> proposed system as this would require remorai of trees and soil located on <br /> his property. <br /> Mr. wade voice his concern with the proposed retaining wali . <br /> Mr, Greelish motioned to deny the request for a Variance on lot <br /> Shore Drive, Mr. Doherty seconded, all agreed. <br /> APPOINTMENT - Cape & Islands - John slavins y - Vari nce request, 5 Ride Run <br /> Mr. John Slavinsky and Attorney Kevin Ki rra,i rye were in attendance for this <br /> requested Variance. <br /> Mr. McQuaid i reformed . the Board the Conservation Commission has . erif ied <br /> the edge of the wetlands. Mr. McQuaid stated the Board -was concerned with the <br /> size of the proposed dwelling and its impact on the lot. <br /> Attorney Kirraine questioned the Board of Health 's juristiction over <br /> wetlands delineation in reldtion to the,p l ac ment of septic systoms and re- <br /> layed that Variances have been granted by the Board of Appeals for lot cov- <br /> erage. <br /> Mr. McQuaid informed the Board the existing "Order of Condi cion " has <br /> expired arid commented this Board i not in receipt of the extension. <br />
