Mr, McQuaid stated he has rade minor rearisiori and <br /> recommends this Board adopt the article as submitted tonight. [fir. McQuaid <br /> relayed the conservation Commission has been consulted and have forwarded <br /> their approval and reported 'the towns of Sandwich and Bourne have adopted <br /> a very similar regulation. <br /> . Evans questioned r, 1 c uadd.a 'to how this will effect repair on exist- <br /> ing <br /> ist- <br /> in homes. ' <br /> Mr. McQuaid replied that repairs can be allowed by the Board of Health, <br /> as long as they do-n't include additionai flow. Mr, McQuaid commented <br /> this regulation- will rake an effect on the _-NuTifienead.. Bay project as <br /> they orginally intended to construct homes within 150' of these resource <br /> areas. <br /> Mr., costa motioned to adopt the "Soil stability" regulation as presented <br /> this evening, r-. Doherty seconded. Th,i s regulation is attached 'to the <br /> end of these minutes <br /> 19. ) Proposed addendum to existing regulation "Le cning. Distarc Requirements" - <br /> Mr. McQuastated there is an unclarity in the existing regulations for <br /> both Title V and Board of Health which increases leaching -to wetlands set-- <br /> back from o' to loo' . Mr. McQuaid stated various engineers take Title <br /> verbatim which states "All d-istances shall be measured from the average <br /> mean a nn ua'I flood elevation or from the mean high water mark in coastal <br /> areas" and commented some wetlands don't have surface waters therefore <br /> has defined water courses which cover all wetlands with the exception of <br /> coastal dune barrier beaches, coastal beaches and coastal banks. Mr. <br /> McQuaid stated distances will be measured from the annual flood elevation <br /> and from. the annual high water mark where surf ace waters exist, otherwise <br /> it wili be measure from the edge of -the wet i and which will be verified b, <br /> the Mashpee Conservation Commission* <br /> Mr. costa motioned to adopt this addendum to the existing regulation <br /> ent i.t 1 ed''," ..each i n -D stance equ i rements u ,,- 1r. -D her'ty seconded.
