Harrington stating that one of the requirements was a hand-washing sink <br /> within the office area. He wasn't naive when he had set up the office. He <br /> did look at the requirements for that space. He had received the <br /> requirements for the massage facility. Prior to signing a four-year <br /> contract at that location. He was in negotiations with Jim Moses who is <br /> the owner of World Gym. His office is within the parameters of World <br /> Gym. It is the same address as World Gym. He brought his contract with <br /> Jim Moses. He has full access to anything and everything in the gym. He <br /> is subleasing space from his facility. During the negotiations it came up <br /> whether there would be adequate water and hand washing sinks in the <br /> area. He wasn't naive to the fact that it was a non-issue for him being the <br /> fact that there is washing and full locker room facility in both the office <br /> and gym setting. As well as a sink in the front reception area. He brought <br /> a layout of the facility in order to show the BOH members exactly where <br /> his office is in relationship to where the sinks are. The chiropractic office <br /> is where the office is and that is where the massage therapy is taking <br /> place. Twenty feet from that office, if they look to the right of his office <br /> entrance. There is a sink and a toilet, bathroom, twenty feet from the <br /> office with full access to his massage therapist. It became a non-issue <br /> when he was looking at the regulations whether or not they had adequate <br /> facilities for hand washing. So when Ms. Warden mentioned under the <br /> requirements to identify B and C. Item 5B says that there shall be an <br /> adequate supply of hot and cold running water at all times. He guessed it <br /> was a matter of interpretation of the regulations. He is fairly educated. <br /> He had four years of undergraduate and four years of graduate school. <br /> Part of his graduate training was in rehab, training in public health, <br /> microbiology and sanitation, etc., which were incorporated into his <br /> training. He guessed it was a matter of interpretation as to what the <br /> adequate supply of hot and cold running water really means. Again, he is <br /> not a separate address or unit. He has common area use of all the <br /> facilities. He processed that this was adequate. <br /> Mr. Doherty asked him if he had an opportunity to discuss this with Mr. <br /> Harrington. <br /> Dr. Lindauer asked Mr. Doherty if he had an opportunity to discuss this <br /> before or after with Mr. Harrington. <br /> Mr. Doherty clarified that he was concerned with "before." <br /> Dr. Lindauer replied that before he came in this was a non-issue. He <br /> didn't bring it up because he didn't feet that it was that big an issue. He <br /> came and spoke with Mr. Harrington. There must have been a <br /> miscommunication at that time. He did get his business permit. Mr. <br /> Harrington said that the space had already been inspected after,,which it <br /> 2 <br />
