Initially, his <br /> negotiations with Mr. Moses were contingent on getting this business <br /> permit. If at that point had he known it was an issue, he has already <br /> stated his case that he didn't think it was an issue. Had he known that he <br /> could have negotiated that into his contract. At this point it is all signed. <br /> Then he gets the letter and it is up to him to figure out what type of sink <br /> he could put in there. <br /> Mr. Doherty began by stating that a couple of things to bear in mind. First <br /> of all the BOH is not issuing the permit to the gym. So the fact the gym <br /> has sinks is irrelevant as far as when the BOH looks at you. You are the <br /> person coming to us as a business entity since you are applying for a <br /> permit and a license. Dr. Lindauer personally or his sublet area doesn't <br /> meet the requirement. Could they grant a variance? He guessed that was <br /> what they were going to talk about tonight. He wanted Dr. Lindauer to <br /> understand that the BOH was definitely looking at him for himself not the <br /> gym. He just wanted to clarify that point. Maybe he took it too much for <br /> granted. But, that was okay. The other issue is that usually they like the <br /> sinks to be pretty close at hand. Obviously, do 1 think that in between <br /> customers are you going leave and wash hands? Yes, he probably would. <br /> He would take him at his word for that. Even in most medical exam <br /> rooms even though there could be ten of them there is usually a sink in <br /> each one. The doctor comes in and washes his hands right there. <br /> Dr. Lindauer continued that it was actually excepted from this situation. <br /> It is the therapists that are working with him that this request applies <br /> too. It is something that he does anyway. Generally, it is an issue that he <br /> considered. This is his second office and he had to go through this in his <br /> first office. <br /> Ms. Warden suggested that the BOH members look at the plan. The sink <br /> in the reception area is for food handling. Mr. Moses does make shakes <br /> with potentially non-hazardous food. That sink is to be used only for the <br /> washing of the equipment. When she went into the massage area. It is a <br /> complete facility within the building. There are four bay areas. Dr. <br /> Lindauer practices his chiropractic services in two of the rooms. The <br /> massage therapist has at least one. There is nothing inside in the room or <br /> the office where you could wash your hands. She could see it being <br /> overlooked rather than coming out and going down the hall. It was just a <br /> concern that they had. They do have the dry wash gels. It just bothered <br /> her because he is a chiropractor. There should be something there <br /> because if he is seeing more than one patient. It could possibly be <br /> overlooked between patients and the same with the massage therapists. <br /> That was both the health agents concerns. <br /> 3 <br />
