Harrington stated that he had issued four citations to people who lived <br /> in Wareham, They had re-modeling done to their house. They hired�a <br /> contractor. The contractor in turn hired someone to dispose of the <br /> material. It made it over to Grafton Pocknett toad.. He never did learn the <br /> actual person's name that did the dumping. All in all everything got <br /> cleaned up. He double-checked if today and they did-a good job of <br /> cleaning it up. The actual contractor cane back and cleaned it up. He <br /> was the one who was hired by contract to dispose of the material. He has <br /> his name and phone number. He has been cooperative. They were looking <br /> at $1200.00 in fines. He sent it to four people in the same family. They <br /> were all included in it and they weren't really happy about it. It got <br /> cleaned up. The board's letter states that they have the ability to clean it <br /> up and the citations will be rescinded if they do. That was sent out before <br /> they were sent a directive from the selectmen regarding not waiving the <br /> g . , which he has comments on also. He has two more illegal <br /> dumping letters to send out pending the discussion with the BOH tonight. _ <br /> He will either leave the rescinding sentence in there or tale it out <br /> depending on how the BOH members feel about the selectmen's directive, <br /> Mr. Santos replied that at this point right novo he did not want to make a <br /> decision without the full board being present. They received it and that <br /> will be that without a full board to discuss It at length. <br /> Mr. Harrington asked if they would lice to bear his comments on the issue <br /> or would they like to wait until Mr. Ball is present. <br /> Mr. Santos stated that it was up to Mr. Harrington on how he wanted to <br /> proceed. <br /> Mr. Harrington stated that the by-law-that they are enforcing is a torn by- <br /> law. It is not a BOH regulation so the selectmen actually have jurisdiction <br /> over it. They can make directives to us because it was a by later. If it were <br /> our own BOH regulation they wouldn't have Jurisdiction to give the BOF a <br /> direct directive. He wanted to just state it that wary. They are one of the <br /> departments that enforce chapter 106 section 106-6, which is the town by <br /> law on illegal dumping. The DPW is a department can enforce its <br /> Conservation can enforce it. so can the Police. They are acting as town <br /> officials under the selectmen basically at that point. If this were a BOH <br /> regulation he would have the opposite to say. He wanted to put that out <br /> there for two weeks worth of nulling. <br />
