Again, the board members expressed a desire to provide him with <br /> a gift. They all agreed to provide individually contribute money towards <br /> this gift. <br /> OLD BUSINESS: <br /> A. Smoking Regulation <br /> Mr. Santos began by reviewing the process that had taken place <br /> regarding the legal review of the prior vote on the smoking regulation. <br /> These discussions had taken place under the "executive session' of the <br /> board of health process. They received a ruling from town counsel on the <br /> vote and how they would proceed from this point. The questions <br /> regarding whether the vote was legal or illegal. He believed that <br /> everyone understood the legal opinion in this matter. The town counsel's <br /> legal opinion was that the smoking ban could be revisited at any time. <br /> There was some discussion regarding the "with prejudice" clause that <br /> would prevent it from being discussed for two years.
