i
i
Mr. Ball stated that he couldn't second that motion because he disagreed
with that position in regards to the bars, So they will have to do an
individual vote. He felt that Mr. Santos and FIs. Grady agreed to ban
smoking in bars and he didn't. Ms, Grady and he agreed with town
property and Mr. Santos did not. They couldn't do it all in one. They would
have to do it in sections.
Ills. Grady stated that "bar" was not one of the definitions here.
Mr. Ball responded that she read that in her motion. she said bar*
Ms. Grady stated that she was now asking for his definition of the word
"bar".
Mr. Ball began looking for the definition for"bar".
Ms, Warden pointed out the definition under "A".
Ms. Grady asked if they had such an establishment that fit the definition
of"bar" in the town of Mashpee.
Dino interjected that that definition was a pourer's license" whereby
they did not have to serge food. There are three types of licenses. The
common victualers where you have to serge with food. There are the in-
keepers where you can serve in rooms such as room service. There is a
pourers" in a bar or restaurant and you don't have to serve food.
Mr... Ball.suggested that Dino could take a section of his bar and not serve
food and it would come under this definition.
Dino disagreed with that example because you had to have one of the
three. You were not allowed to pick and choose that way, He said that
the only person in town that had an in-keepers license mould be Richard
Halpern at Zachary's Pub. He could serve in the grooms that he rents and
on the grounds. As far as the "free pourer' he didn't believe there was in
town. There is a provision in the current regulation that if there is an
establishment whose receipts of liquor are % or more, then technically
it is not a restaurant.
Ms. Warden disagreed with this position because they would hold a food
service establishment license.
Mr. Mitrokostas understood what she was swing but food became
incidental to the consumption of alcohol.
39
