ICAs, Warden stated that that would return them to the definition again. <br /> Mr. Mitrokostas agreed and said that there are arguments back and forth <br /> to what degree is it a bar or a restaurants. <br /> Mr. Harrington interjected that to answer Ms, rady's original question he <br /> did not believe that there any true stand alone bar or lounges in Mashpee. <br /> Every bar that they have in town has a restaurant associated with it. <br /> Mr. Ball asked if they could give thein an opportunity to separate it. But, <br /> they couldn't because they would have to have two different licenses. <br /> Mr, Mitrokostas, speaking officially and unofficially on behalf of the <br /> restaurant owners, their intent is not to find loopholes. They just wanted <br /> to try to find a solution that everyone was happy with. They weren't going <br /> to sit there and dissect the whole process. They have enough to do to run <br /> their restaurants let alone go and find a lawyer to find loopholes and <br /> everything else. But, if you have a food service establishment where 75% <br /> of their receipts is liquor then the food service becomes incidental to the <br /> operation. He could serve a bag of chips and a cold sandwich and call <br /> that food along with tons of liquor, <br /> Mr, Santos felt that they needed to move forward with section IV. <br /> Ills. Grady had made the motion that the ban would include the previously <br /> mention locations. <br /> Mr. Ball asked if she didn't want to address the.town property issue first <br /> and separate it out. If she separated it out he would go along with some <br /> of it. <br /> Mr. Santos reiterated the original motion made by Ms. Grady as follows, <br /> "the smoking ban would include that smoking shall be prohibited in all <br /> food service establishments, lounges, bars and town owned, operated, <br /> lease or occupied buildings and grounds,, excluding public beaches." It is <br /> basically everything here but he just didn't agree with the inclusion of the <br /> "grounds",, <br /> Mr. Ball stated that noone seconded that motion, so, he began to make a <br /> motion that they ban... <br /> Ills. Grady interrupted IIr. Ball and stated that she would have seconded <br /> that motion if Mr, Ball knew where Mr. Santos began and ended the <br /> motion. Did he know where Mr. Santos read it <br />
