t
to add more to this fine?
Ms. Grady felt that if they already had a $200.00 fire in place. Why would
they want to lower the fine?
Mr. Santos asked if they didn't want to issue a warning for the first
offense, 1 oo.00 for the second or just $200.00 first time.
Mr. Mitrokostas tas asked if this was going to be for the establishment or the
person.
Mr. Santos replied that it would be the establishment fine.
Mr* Mitrokostas asked about the person,
Mr. Santos replied that the person would he a $50.00. fire*
Mr, Sall interjected that he felt that a warning was more appropriate. They
.always gage people warnings even food establishments before they shut
them down, They always give them a warning with the critical and non-
critical including the illegal dumping and things like that. They have been
fair with the public. Let's do the warning and fines afterwards with a one,
two, three-step process.
Mr. Harrington stated that has to do with the establishment. it is "P"
that is with the individual just to clarify the areas of the regulations.
Mr. Mitrokostas felt that the BOH should fire the people more than the
establishment, You ask therm to stop smoking and if they dory"t then they
will call the police.
Mr. Santos didn't feel that that was the best scenario. if the food
establishment is trying to adhere to the regulation and the person is not
complying thea that is a different situations However, if a board member
walks into the bar and there are fifteen guys smoke at the bar is a whole
different scenario,
Mrs Mitrokostas felt that that was why a hearing was necessary. He felt
that everyone needed ars opportunity to discuss what happened. They d
their best to keep everyone under control, but it doesn't always work*
Mr. Harrington stated that if he were to conte.to their establishment. He
was going to fine the establishment or somebody smoking. He wasn't
ping to go out there every five minutes for somebody smoking. He was
going be wasting his time to do than He will issue a $500.00 fine. He
didn't cage because he was not going to go through it.
1
