He pays for one pack <br /> of cigarettes but two are attached together. The state mJnimum for that i <br /> noir a one-pack price, so the boards regulations as written in no moray <br /> stops two for ones or buy three get two free etc., because they now bill <br /> those out at wholesale and the state minimum is set upon that wholesale <br /> price. He could get the literature from the state if they couldn't. He felt <br /> that that was extremely clear and was clarified last year, So again h <br /> would respectfully disagree as it was written that anything in Section c <br /> stops the buy one get one free buy three get two threes etc,, What they <br /> could not do by state or Federal regulations are hand out any free <br /> products. They could never be handed out free. <br /> Mr. Santos stated that he thought they could spend all night mere splitting <br /> hairs really, if you get a package and it has two packs of cigarettes and it <br /> has a price on it. Then it is considered one pack. What the board was <br /> trying to say was that if you buy a pack of Marlboro's you get a free one. <br /> That was the way he looked at it. They could get the lawyers in here and <br /> go round and round for about a year. <br /> Mr. Anderson interjected that the state has gone through this for two <br /> years with the state. <br /> Mr. Harrington stated that the state was dealing with wholesale and the <br /> board at the local level was dealing with retail. These were retail <br /> regulations. They don"t care about wholesale. They were talking about <br /> over the counter. You pay for one pack. if you get three, that's a free <br /> pack. There should be a state minimum if there is a price per pack. <br /> Mr. Anderson stated that he tended to agree. The state minimum a <br /> defined in Massachusetts is a very defined thing. The state minimum for <br /> the package of Marlboros that he gets in the store that's to packages <br /> connected together. The stateminimum price for that is the price for one. <br /> That has been clarified by the state and re-clarified by the state to them. <br /> To be honest he was not even here to discuss section C. But, if it comes <br /> into interpretation later it will. But, he didn"t think any of them would stop <br /> f selling by one get one free because it has already clarified by the state <br /> very clearly. _ , <br />
