Mr. Ball asked him how many bedrooms the home had. <br /> Mr. Harrington responded that it was a two-bedroom home. The amount of <br /> land in total was 23,500 square feet, which equates to 258.5 GPD. But, the <br /> septic system itself was built for 247 GPD. Ultimately the two bedroom <br /> plus the kennel was 270 GPD. There are several things going on here. <br /> There was an easement restriction that was recorded, which stated that <br /> this property has to remain a two-bedroom and no more than two- <br /> bedroom. That essentially was not maintained by the addition of the <br /> fennel at the property with the additional 50 GPD for the kennel. He wrote <br /> therm a letter stating that they had an immediate ceasd and desist in the <br /> kennel operation at the property because they were out of compliance <br /> with the recorded easement use restriction for the property according to <br /> the nitrogen aggregation plan that was done. At that time they did not <br /> have the information, the actual recorded use and restriction pian. He <br /> guessed that it had been sent here. But, it did not make it into the folder. <br /> Mr. Bateman provided that document. That portion i okay. At this point <br /> they requested a hearing within the seven days of receipt of the BOH <br /> order letter. They were here tonight to either amend of modify the BOH"s <br /> order, At this point he and Mr. Bateman had spoken today. He could get <br /> more lana to use for credit to make up for the so-called 23 GPD-that he <br /> was short. That would be a way to comply with the Tale 11 portion of this <br /> problem* That works out to 1090 square feet he would have to purchase <br /> somewhere and set aside as conservation land. He would have to go <br /> through basically another nitrogen aggregation plan because he would <br /> have to modify the one that was on file right now. <br /> Mr. Bateman asked if the board had the Title V or health department <br /> regulations that describe or constitute a kennel. <br /> Mr. Harrington stated that in Title V it merely says "kennel/veterinary <br /> office . <br /> Ms, Warden interjected that Mr. Bateman had already reviewed that <br /> document. <br /> Mr, Bateman stated that he was hoping that they would have a definition <br /> of a kennel. <br /> Mr. Bali asked Ms. Daley, animal control officer, if she had any comments <br /> regarding this situation. <br /> Ills.
