Y• FIs. Garron added that there was a lot about this property that he didn't know. Mr. Harrington added that Dr. Patel bought this place without knowing about the 600 GPD regulation. He was going to be bringing hire in front of the board to bring him into compliance with the regulation. Mr. Sall felt that this was another Deer crossing. Ms. Carron added that the interesting thing that Dr. Soliz brought up was that It does not say on our permits anywhere that it was "non- transferable s Mr. Harrington noted that it was in the town regulation. Ills. Grady added that Dr. Patel paid this to the old owner. Mr. Harrington noted that they could provide it as a service. Ho w►everg people are supposed to come and look at the regulations before they buy a property. Ms. Grady asked if they didn't recently okay some neer septic upgrades for the La Planar Del sol. Ms. Garron stated that the house in the front was repaired. Mr. Harrington agreed that they did an emergency repair for the house with the apartments, it was last summer, Ills. Grady asked If that was a separate system than the hotel, Mr, Darrington responded that legally they should have caught it at that point, When that septic system failed it was all part of the same property. Maybe he didn't screw up to badly. It was two separate properties, our regulation doesn't kick in like Title V does calling it "one facility's, our regulation is written per property not per ownership. If they had done the regulation "perownership" it would have kicked in the 600 GPD regulation at time of failure or time of transfer. But, it was a separate property. The motel itself was over 600 GPD so when that property transfers or fails it .will have to be upgraded. Mr, Sall felt that he would go with whatever Ms. Grady wanted to do, Ms. Grady felt that Dr, soliz should have returned the $200,00 to Dr. Patel.
