She felt that his disagreement should be with Dr* Soliz and not the board.
The only other thing they could do was waive the fee. The fee would not
be transferable and by the way you would have to upgrade the system.
Mr. Harrington stated that Dr. Patel knew that.
Ms. Grady Ornade a motion to deny the request to waive the motel permit
fee, Mr. Ball seconded the motion. Motion passedd
B. FYI - Fells Pond Algaecide added over Three bears
Mr. Harrington began by stating that Fells Pond in New Seabury has
entered into their third year of adding an algaecide to the pond* The BOH
had never been notified. He just wanted to make the board members
aware that he was going to send a memo to the Conservation Commission
that a condition was needed notifying the beard of health any time a
hazardous material is added to waters of Mashpee. They would like to
review the information.
Mr. Ball asked if Conservation had been notified.
Mr, Harrington responded that they received a notice of intent. What he
had been told is that typically on the notice of intent a condition of the
notice of intent that is set by the conservation Commission is to notify the.
board of health.
Ms. Grady asked if Mr. Harrington thought that they were notified.to do
that and neglected to do s .
Mr. Harrington did not feel that they did this intentionally. The
Conservation Commission did not set it as ar condition because the BOH
had not requested that of them* He was going to send a memo to do that.
He drove down there and saw the notices that Fells Pond had just been
treated with the chemical. He was like "what's the chemical and. how
often was it done It had fishing and swimming restrictions. He was like
"hello" we have two bathing beaches in this pend and the board wasn't
notified? Granted that they didn't get any calls on it has amazed him, But,
the reason why they didn't get ells on it was because it was the third
year and very small amounts were added as maintenance. They were
treating small little spot places. He called one of his former associates at
Barnstable, Dr. Dale saad. she has a Phd in water chemistry and oversees
the Barnstable water quality* There was a smaller pond near wequocket
that they had administered this type of treatment to to knock down
another weed that was taking over that pond* He called her and asked if
there was a requirement through the wetland protection act or anything
iselse that says that you have to notify the board of health* There is no
7
