t <br /> I <br /> Ms. Warden added that the top letter was in response to the letter below. <br /> This letter was not sent voluntarily it was sent in response to the board's <br /> letter. <br /> Mr. Ball asked Mr. Harrington if he had any recommendations, <br /> Mr. Harrington responded that there were a couple of things that could b <br /> done, These recommendations were taken from Title V if the system <br /> failed as part of a transfer inspection. They had two years to fix if. The <br /> ether options were taken from that if they didn't fix it. The board has the <br /> right to condemn the property and give a five-clay order to vacate the <br /> premises. If they did that they would have to find out more of the details <br /> of the situation regarding the petition to partition and then at the next <br /> meeting make a decision. The other thing wasthat they could enter into <br /> an enforceable agreement with the board. The enforceable agreement will <br /> set the conditions that they do keep the system pumped. They will have a <br /> contract with a pumper and the system will be upgraded within a certain <br /> amount of time after the other court proceedings were completed. He felt <br /> that those were two of the options. If the board did wish to go the <br /> condemnation route they should wait one more meeting, For one they had <br /> to give thein five days notice and they only had two days notice for this <br /> meeting. They have to re-send them another certified mail to give them at <br /> least five days notice. He also thought they needed confirmation from the <br /> attorney as to how long this process was going to be. He didn't known <br /> exactly what their status was at this point in times <br /> Mr. Ball asked the other board members if they had any other comments. <br /> Ms. Grady noted that in one of the letters it stated that the town didn't <br /> have the funds to do anything. <br /> Mr. Harrington stated that at one time the town had run out of money for <br /> the septic loan program. That was correct at that time. <br /> Ms. Grady asked if they had been in touch with Mr. Ayers from the county. <br /> Mr. Harrington believed that they had completed the paperwork with Mr. <br /> Ayers. They did sign up for the loan in March of 2003. <br /> Ms. Warden stated that she had spoken to Mr. Ayers and he had tried to <br /> contact them twice onc6 in September and again in October without <br /> success. <br /> Mr. Harrington that the latest attorney's letter that they tried to contact <br /> Mr. Ayers to no avail and Mr, Harrington did not believe that.
