Then they were saying that it was <br /> technically sufficient. That pretty much ended their responsibility. If it <br /> was town owned land or even deemed conservation land* They had to go <br /> through the cape cod Commission and the state. <br /> Mr. Darrington stated that they did not have to go through the cape cod <br /> Commission, He re-iterated that it had to go through the DEP, the town <br /> and the legislature. It was definitely not an easy row to hoe. <br /> Mr. Ball stated that he was trying to recall this to the best of his ability. <br /> He felt that something was missing. The original plan when it was <br /> submitted to therm there were reasons that led to the how the current <br /> subdivision was arranged and why this open space was available to that <br /> they could put the square footage of the lot...lt was probably prior to Mr, <br /> Weinstein that they recommended tern house units to have denitrification <br /> units and the contractor at that time agreed with that. <br /> IIIb. Weinstein stated that they were working off of a special permit and it <br /> was not a condition. It was one acre zoning and the developer at the time <br /> could have requested a fifty-house subdivision plus the roads. That was <br /> less than thirty-five. It was one acre zoning. <br /> Mr. Ball felt that they probably had to cut a deal to give you the same <br /> amount of houses with less square footage. <br /> Mr. Weinstein stated that there were 15 less houses. He feels that since <br /> the conservation area is within his subdivision makes a big difference <br /> than his requesting the use of conservation area that was located across <br /> the street from Ms: Grady. The next step in that scenario would be to go <br /> to town meeting or DEP further down the road and wouldn9t. probably b <br /> allowed because it didn't have anything to do with his original request, <br /> The proximity, in this case, in the way this whole thing was set up. When <br /> he this thing the torn was able to use that conservation area because it <br /> was part of the subdivision.
