But, those are net <br /> one-acre lets. If they gave up the 20.6 acres of open space the planning <br /> board gave them the variance to use the smaller square foot rots at a <br /> higher density. That was theso-called deal on their special permit. He had <br /> copy of the special permit if they granted to look at it. <br /> Mr. Ball felt that they were going to have to move this along. <br /> Ms. Grady agreed. <br /> Ir. Ball asked what say the board. Did he hear any motions to agree to do <br /> what the board recommended? He assured that they would have to make <br /> the language of the torn counsel's letter into a motion. <br /> Mr. Santos made a motion to approve the proposed nitrogen loading <br /> aggregation plan for the Great Hay Acres as it is technically sufficient and <br /> complies with the requirements of'Title V., subject to additional approval <br /> as required from the commonwealth ealth of Massachusetts Department of <br /> Environmental Protection. Approval of the pian and a required easement <br /> for use of the designated conservation land for purposes of nitrogen <br /> loading aggregation must also be obtained from the town of Mashpee, by <br /> a two-thirds vote of town meeting. Approval of the easement on <br /> conservation land must also be obtained from the commonwealth of <br /> Massachusetts, by a two-thirds vote of the General court. This motion <br /> was taken directly from the letter from Kop lrnan & Paige dated 02.26.04. <br /> Ills. Grady asked if they could condition the motion that they would not <br /> have to go up in front of the town meeting requesting approval for this <br /> request. <br /> Mr. Ball and Mr. Santos agreed that that portion of the process had <br /> nothing to do with them. <br /> Mfr. Ball stated that if it carne to that they would fire up a letter stating <br /> that they agreed with this requested plan. Mr. Ball seconded the motion. <br /> Motion approved. <br /> Ills.
