i <br /> .k <br /> Mr. Donaldson stated that they had been running it for two years and the <br /> first time that the certificate had expired. <br /> Ms. Grady asked if they understood when they had to renew their permit <br /> by for the date. <br /> Mr. Harrington stated that they have 30 days prier to the expiration date. <br /> The board sends out the notices in October early November. All of the <br /> establishments had basically thirty days or 60 days to get it in by the <br /> beginning of the calendar year. They did put any further enforcement if it <br /> was just a little bit after the calendar for receipt of the permit application* <br /> The majority of the establishments have therm in by the first of the year. <br /> They give a little leeway over the holidays. The code says thirty days prior <br /> to the expiration, So at the end of November they should have received all <br /> of thein. But, they give them a grace period through the holidays. This one <br /> slipped through the cracks and necessitated the board sending therm a <br /> notice. <br /> Mr. Ball stated that they had three options here. This was the first time <br /> that this ever happened. He would be satisfied with just a warning. <br /> Ms. Grady asked if Mr. Santos had any problem with that. <br /> Mr. Santos stated that if they did not renew the next year's application <br /> within the thirty-day time frame they would consider going in and dose <br /> the business down because they were operating without a permit. He felt <br /> that they needed to appreciate the fact that they were a lenient board and <br /> they tried to work with people. it was also1heir obligation to enforce the <br /> laws that they had in place. <br /> Mr. Donaldson acknowledged Mrs Santos comments@ <br /> Ms. Grady made a motion to issue a warning to the Fountain of Juice for a <br /> failure to renew their food permit in a timely manner and operating their <br /> establishment without the appropriate licensure. The owners will be in <br /> before 12:00 tomorrow to submit the application with payment. Mr. Santos <br /> seconded the motion. Motion lead. <br /> Ms. Grady made a motion to change the agenda schedule to hear 8:00 PM <br /> appointment instead of the 7:30 PILI. Mr. Santos seconded the motion, <br /> Motion passed. <br /> Mr. Ball stated that they would still have to wait until 8:00 PM for it to be <br /> legal in case someone does come it to discuss this agenda item. <br /> 3 <br />
