R
spaces They said no because everybody in that whole development owned
that parcel. Hera could you divide it among each of therm? They did not
want to go down that road.
Mrs Ball asked if they were opening up Pandora's Box if this were to cone
in front of therm in the future.
Mr, Harrington stated that they had already allowed nitrogen-loading plans
for other peoples
Ms. Grady stated that it did not include torn owned land.
IVIr. Ball stated that they had to buy another piece of land to make up the
square footage.
Ms. Grady added that the other case was Habitat for Humanity,
Mr. Harrington stated that Habitat for Humanity did go to town meeting.
So they did follow the proper format and it was not conservation laud so
they did not require the two-thirds legislative vote. They did everything
right by the book. This was the same process except that this was
conservation land and it had to go to the legislature. He didn't think the
board was opening themselves up. He felt that if they denied it they mould
be opening themselves up because they had approved it for other people
as long the process was followed.
Ms. Grady interjected that they had not approved it for other people using
conservation land that was owned by the town,
Mr. Santos felt that he understood IVIS. rady's position. He recommended
that they read the last page and make the motion to approve the proposed
nitrogen loading aggregation plan at it's technical sufficient and complies
with the requirements of Title 11. They were not giving them the final say
to go ahead and do this. He had to go back through all of the other
channels to get approved. It would then come lack in front in therm again
for the final approval,
Mr. Harrington disagreed and stated that it would not come back in front
of the board. They would approve it...
Wls, Grady interrupted and stated that they were looking for approval of
the usage of town property. she didn't see hog they had the right to do
that, If it went to a town meeting, would they be called up when they
state that the board of health approved. The board would have to state
that they agreed to let them use conservation land.
T
L
