Request for Title V Variance: 397 and 403 Great oak Fuad <br /> Mr. Harrington began by stating that he had reviewed this plan. His one <br /> comment and request was that Cape & Islands request this variance <br /> because there were septic systems that were going to be proposed 1501 <br /> to the coastal bark. That needed to .be requested because of the soil <br /> stability regulation. As they could see on I'D" on the soil stability <br /> regulation 11 coastal banks composed of unconsolidated sediment, to <br /> include the seaward face or sine of any elevated landform, other than <br /> coastal dune, which lies at the landward edge of a coastal beach, land <br /> subject to tidal action, or other wetland." They should take a rook at these <br /> properties. They are right on the wetland and right against the top of the <br /> coastal bank, Also the septic on number 397 was 601 and 403 was 120' <br /> from the coastal bank. This was one property at one time. The ZBA gave <br /> therm the approval to subdivide it into to properties. It shortens all of the <br /> setbacks considerably. <br /> Mr. Sall asked Mr. Harrington to delineate the coastal back on the plans <br /> for him. <br /> Mr. Santos pointed out the top of the coastal bank for Mr. Sall. <br /> Mr. Harrington produced a pian that was revised. The new plan stated end <br /> of coastal bank, one property itself did not have a coastal back, but the <br /> septic was still 1501 of it. The tanks were even closer but the leaching <br /> was 120" and 601. <br /> Mr. Ball stated that the 60v was an automatic denitrification. <br /> Mr. Harrington replied that they were proposing a denitrification. But, with <br /> the BVW they have the 1001 so they did not have to do the UV treatment. <br /> i <br /> Mr. Santos asked if they were basically worried about the hank and any <br /> breakout. <br /> Mr. Harrington stated that this regulation dealt with soil stability as far a <br /> the coastal bank. As far as he knew this was a vegetated coastal bank. <br /> This was not open with sand falling away. This was a relatively stable <br /> bark. He felt that it met the regulation 48 by definition. cape & Island did <br /> say that there were no shifting sands or earth at this location. Therefore, <br /> they were requesting the variance. The first paragraph of the soil stability <br /> regulation states No newly constructed septic s st ms, nor expansion of <br /> existing septic systems shall be permitted within 150 of any area where <br /> there is active shifting sands or earth. The delineation of such areas shall <br /> 5 <br />
