I
I {
i
I
be shown on a plan drawn by a Professional Registered Engineer and
verified by the l ashpee conservation Commission or its agent." They
have been through Mashpee Conservation Commissiom It was a coastal
bank. He was not sure if there were active shifting sands at this-property.
He believed that the banks were vegetated. It was the board members
call.
Mr. Sail asked if they"could require denitrification for both,
Mr, Harrington stated that denitrification systems were proposed for both.
He stated that they could put further restrictions on them If they wanted i
too, As far as he was concerned this variance applied and that was why
he requested it.
Mr. Santos felt that the purpose of Regulation 48 was that even though
there was no shifting sand. It was fry.a flood plain. The elevation was
pretty shallow and if they ever got a heck of a coastal storm. It would eat
away and getting into that system. He felt that that was.why they wrote
that regulation, it basically stated-new construction only.
Mr. Harrington re-iterated that it said, "No newly constructed nor
expansion of existing septic system shall be permitted within 'I V' so
they were even going for repairs.
Mr. Santos asked Mr. Harrington if he had looked at these lots.
Mr. Harrington stated that he had looked at the lots.
Mr. Santos was concerned if there was any evidence at lean high tide if
these banks were getting washed with waves.
Mr. Harrington replied that it did not appear to because it was on the
pond. They would see-flooding. But, he didn't think they would see any big
wave action.
Mr. Santos stated that that was what bothered him.
Mr. Sall rade a motion to grant the variance of 301 from the top of the
coastal bank to the proposed septic system for 397 Great Oak Road and
variance from Regulation 48 - soil stability. Mr. Santos seconded the
motion* Motion passes.
Mr. Ball made-a motion to grant the variance of 901 from the top of the
coastal bank to the proposed septic system for 40 Great Oak Road along
with UV treatment and a variance from Regulation ulation - soil stability.
