measured some of the retail and office space finding it different than <br /> shown on the plans. They think they could easily make up the remaining <br /> pB. That was where they were. They have had to establish clearly ghat <br /> the seats were and where they should be now, <br /> Mr. Harrington felt that Nor* McGrath stated very and very clearly that the <br /> BOH was,in a very sticky situation right now' where there had been <br /> approvals after 1995, 13ut, there had also been approvals that the BOH had <br /> made regarding the additional seating for the permitting of the food <br /> establishments. They were going to be damned if they do and damned if <br /> they don't know matter what they decide. He felt that it was worthy of the <br /> board if they wanted to-step back and either go to town counsel or review <br /> this entire thing in executive session before a decision is made because <br /> they were going to be stuck between a rock and a hard spot. They were <br /> not going to male any friends with any of the decisions that they make. It <br /> would have long reaching implications. <br /> t <br /> Ms. Grady asked Mr. Harrington if he would tell them what the "sins of the <br /> past:were for the gree restaurants. <br /> 1VIr. Harrington stated that basically when he went back and dict his review <br /> this was what the board had approved and he had found. carbols had 70 <br /> seats,, 65 seats for Michelle's and 74 seats for 'iovanni's (Michael's). <br /> x <br /> There was as actual request with an application that stated 80 seats that <br /> was date March of 1997. But, the pian that.was submitted along with <br /> that showed 74 seats. He was not sure which was enforceable the 80 or <br /> . There was no bar area included in that. The existing permit right now <br /> for iovanni's saes 77 seats., That number was arrived at, as was <br /> explained today, that there were main dining room seats and 11 bar <br /> seats. But, they did not have anything on file regarding when the bar was <br /> installed and arrived at the number 77. There was something along with <br /> the liquor license. The 66 and 'I I came through with the liquor license in <br /> process. Again, nothing was approved through the BOH to get to that 77 <br /> number. so he referred it back to the 74 that were on the site plan that <br /> the board did approve. <br /> Nis. Grady asked as far as carbo's was concerned did-this include the <br /> outdoor seating* <br /> Mr. Harrington stated that there was no outdoor seating included in the <br /> permit. He thought that the whole approval with the outdoor seating Was <br /> not under erroneous occurrence as far as the flow numbers that they were <br /> using based on the additional board's approval. <br /> Ms. Grady asked Mr. Ball and Mrs Santos if they had any additional <br /> 9 <br />
