He wrote the board of health a <br /> letter on 05.1 4.04 about his discussions with the DEP. He had been trying <br /> to get the OAR systems approved for buildings A, B and D, at Deer <br /> Crossing. The department examined all of the permits back to when Deer <br /> Crossing had been constructed, The DEP has said that as far as they were <br /> concerned the flows that existed on March 3161, 1995 are the only flows <br /> that could exist at the complex. Since it appeared that there has been an <br /> increase in flow, the DEP was telling therm that they had a right to <br /> aggregate all of the flogs and corrupting the entire Deer crossing. They <br /> were saying that if the entire flow of Deer crossing exceeds 10,000 GPD <br /> they would have to go for a groundwater discharge permit. What he had <br /> done was sent the board a letter that basically went back to the original <br /> disposal works permit that identifies the flows that existed at the <br /> restaurants time of the original installation* What he was asking the board <br /> to do was to confirm that those were the seats that actually were <br /> J <br /> authorized to exist, The.board of health had a regulation before 1995 that <br /> said that every commercial building that was building an'SAS there had to <br /> be two soil absorption systems. so if two were proposed they actually <br /> y <br /> built four and separated them with,a valve. There were two approvals <br /> after March 111,-1995, when they authorized an increase of flow b <br /> remedial! valve, According to the DEP it was not authorized until Title 1 <br /> and because that was apparently gone here it has caused a "catch 221Y, <br /> The geo-hydraulic study and a design was probably $65,000-00 in <br /> construction costs. The discharge permit was in the range of$700,000.00 <br /> to 00, 0. easily with an additional loss of several thousand dollars <br /> They were looking at numbers that were approaching $9009000-00 easily <br /> without allowing for any relocation of utilities, which appeared to be a big <br /> hassle at Deer crossing. What they were trying to do is establish an <br /> agreement that the restaurants seats were the ones they were originally <br /> permitted for.. They have ;Michelle's at 65 seats, Darbo's at 58 seats and <br /> Michaels Dtovanni's at 56 seats. He complied this information from the <br /> original designs. In any case, the restaurant owners however, seem to <br /> have letters that identify a greater amount of seats. Unfortunately, the <br /> DEP is of the opinion that no increases of flows should have occurred <br /> after the ;March 3121, 1995, date. Since they have occurred the DEP <br /> believes they have to aggregate and an aggregation was very expensive, <br /> So, he wrote the letter hoping the BOH would agree with hirci then the <br /> aggregate for the whole place would be 10,200 GPD.
