Nlr. Harrington confirmed that that was correct and the board was more
laic at that point as far as counting the seating. They had been very strict
on the bedrooms. The bedrooms were documented. if it was not
documented they had other processes to go through to confirm that
number. They had been restricting the residential. They were just
catching up to the commercial,
Ms. Grady asked about the previous meeting when they gent before the
board of selectmen to request 70 seats.
Mr, Harrington responded that it was for their liquor license.
Ms. Warden n added that that was for the capacity for the fire department,
what the facility could hold for number of people.
Ms. Carron added that another point was that a majority of these
restaurants that they permitted were connected to sewerage' treatment
plant through Mashpee Commons. so the seating issue was hot an issue
for the bulb of those restaurants, Whereas in Deer crossing there were
only three restaurants that carne into play. She didn't think it ever really
occurred to anybody that this was an issue until now.
Ms. Grady asked the board members what they wanted to do*
i
Mr. Sall wanted to give it a little more time.
Mr. Santos agreed with Mr. Harrington. They were not going to tell the
restaurants that they were going to reduce their seats. They were saying
this from day one. He didn't want a pissing contest. Mr, Hajjar wanted the
board to be the had guys and the restaurants were going after hien
I k
because he screwed up from day one. He -knew about all of this stuff.
They had all of the documentation. so if they wanted to battle it out
legally, Mr. Fa Jar was going to lose. He had only one other point.
The
health agents Dept bringing up the point that they have exceeded their
seating capacity. He had never seen even an FYI in front of this hoard
saying that Michael' / lovanni's or carbo's in violation and it was
documented with an order to remove those seats. Had they been giving
I
warning Was it documented and enforced?
Nis* Warden replied that it was enforced.
Mr. Harrington stated that it was documented on the inspection form. It
didn't always make it to the board because they gave there the chance to
reduce the seating. That had occurred.
6
