In that they found that the refrigerator boxes <br /> that were in the walk-ire refrigerator were being held longer than seven days from the <br /> date of their delivery. The way it was explained to them when they got to the store <br /> was that Stephanie and Beverly stated that when the delivery carne the floor freezer <br /> was not in use. They would bring the product directly into the refrigerator. In that <br /> case the seven clays should start from the date of deliverer. That was how they were <br /> handling their inspection. They found several boxes that were delivered on August <br /> ', 12 , 1 and-16�'. Some of those boxes weren't even openedy et and put out for <br /> service. One thing that both Stephanie, Beverly and Haddad had explained to them <br /> was that when they got int.o the walk-in cooler that they used white buckets. The <br /> sandwiches were pre-sorted by type. Then they were put into individual daily <br /> service. It was dome orderly and labeled except that the food that was being put in <br /> there-was visibly moldy. It was not all ofthe food but enough of therm for the hoar <br /> to not take any chances. So they discarded the entire contents of the boxes. <br /> IVIS. warden stated that there was a label on the box or the label that they placed on <br /> the boxes was the day that it was placed into the container. That was what Beverly <br /> had told there. <br /> Mr. Harrington confirmed that the individual white boxes were labeled for each <br /> bay's service for that corning week. They found it an acceptable practice. However, <br /> the material that was going into therm was being held beyond there seven clays of <br /> refrigeration. There was no way to document at that point if the materia] was coming <br /> in as delivery and then being frozen for some point and then being brought to the <br /> refrigerator. It was explained to therm that they were not using the freezers. It was <br /> coming directly from the delivery into the refrigerator. That meant that the material <br /> was out of date. It was visibly moldy. It was already in a contaminated state and <br /> being served that way. At that point they did that inspection in the morning and <br /> issued the violations. Where were six violations in total that were found. After they <br /> did the inspection he carne back to the office and contacted the board members. It <br /> took a little bit to get a hold of everybody and get a eoneensus on what the board's <br /> recommendation should he at that point. Then Ms. Warden, Mr. Santos and he went <br /> back to the store and issued the cease and desist with the emergency closure. The <br /> imminent health hazards that were found included the food being served beyond its <br /> seven day holding time. Also, there was no ServSafe Certified food manager on site. <br /> The person in charge, if there was one, as far as an alternate person. That alternate <br /> person was not operating the store in accordance to the food code. So that in itself <br /> led to not being able to read Mobil's own protocols for reviewing expiration and <br /> shipping dates. Resulting in the food being sold beyond it's expiration. The hearing <br /> was requested by Ms. Gromelski as legal representative of Mobil. Mr. Harrington <br /> suggested that Mr. Shultz explain why they did not have a Ser Safe person and what <br /> he might have done to rectify that situation along with any planned training. <br /> Mr. Shultz,began by stating that they had two employees that were Ser Safe trained <br /> as of a month ago that resigned.
