four of the units in the lower area. They appear to be run very well. But, they are <br /> now in the process of moving out. They went next door into unit B2 where there was <br /> a food storage unit. Mr. Patrick Moloney had that unit built up back in January. <br /> There were electric permits to put in the lights and refrigeration that was used. He <br /> mainly serviced Nantucket as A food distributor. He had a frozen mobile food truer <br /> that he uses. It was quite an elaborate track.. He had no problems with the truck r <br /> the facility itself as far as the inspections process. They asked him because he chid. <br /> not have a permit and did.not notify the board when he went in there in January. <br /> Also, in thatprocess they found out that the building did not have an occupancy <br /> permit. They as the board ofhealth could not issue any permits when the building <br /> has no occupancy or the right to be occupied. So at this point he would like to <br /> continue this. His operation is run very well. It was clean. He had been in operation <br /> for quite a long time in Sandwich and had just moved as of January to Mashpee. At <br /> this point they had not investigated the full requirement to bring the building into <br /> occupancy. The use ofthe building was pretty innocuous. It fell within the Title V. <br /> As long as the church leaves, because the church pretty much maximizes the Title V <br /> use of the building. Also, it has the wetlands. It had water restrictions on it also. So, <br /> the church has been given some time to leave. If the church leaves the uses in the <br /> building will probably be okay as long as the occupancy of the building is corrected. <br /> At this point he was not sure what would have to happen with the building <br /> department to male the occupancy happen. This gentleman has some money sunt <br /> into this unit. He" got the refrigeration with the nice walk-in in that was rept clean and <br /> at the right temperature. He would hate to have to have him lose that but when it <br /> came down to the rules and regulations. He was not supposed to be there because the <br /> building did not have occupancy. He felt that they should continue this for a couple <br /> of weeps until they could figure out what could be done with building, <br /> Mr. Ball made a motion to continue per Mr. Harringt n's request, <br /> Mr. Santos would not second the motion. He felt that this was just as bad as with <br /> Mobil. If he was in the business, he knew he was supposed to pull a permit. Granted <br /> he night be within the code and everything looks good. He was not supposed to be <br /> in the building. He did not notify anyone that he was in there. At least he warted <br /> hire at the next meeting to cone in front of them and explain why he hadn't pulled <br /> permit. It seemed lire they were really starting to clean things up around here. They <br /> were playing hardball and he felt that they needed to be consistent on it. <br /> Mr. Harrington interjected and stated that he told him not to come. He understood <br /> Mr. Santos position. He told him not to come basically for the fact that there may <br /> have been a chance to at least to get the building and the permit portion of it. If they <br /> wanted to take enforcement that was another issue. At least as far as the permit <br /> issue he should at least find out what could be done with the building the next <br /> couple ofweeks. But, as far as the enforcement that was up to him. <br /> Mr. Santos stated that with that said he would second Mr. Ball's original motion. <br /> Motion passed, <br />
