He was in violation already. <br /> Ibis. Grady wanted him to wine before them at the next meeting. <br /> Mr. Sla insl y stated that he could change a plan in a day. It was not something,that <br /> would take a month. <br /> Mr. Ball felt that that was their only avenue. <br /> Mr. Santos was in agreement. But, he wanted a certified letter. <br /> Mr. Harrington stated that all ofthe board orders were seat out certified. <br /> Mr. Santos continued by stating that on receipt of the certified letter he was being <br /> fined $300.00 per day for failure to follow the direction of the'board of health b <br /> having the plans submitted and the system installed. He had the right to come in <br /> front ofthe board and argue the case. <br /> Mr. Ball asked if he wanted to go that way. <br /> Mr. Santos added that on top of that on receipt of this letter any food permits would <br /> not be renewed at the turn of the calendar year. <br /> Ms. Grady wanted him notified that the next meeting was October 281', 2004. <br /> Mr.`Santos stated that he was tired of being blown off. <br /> Mr. Slavins y added that Mr. McNulty had never called him and said, "Change the <br /> plan." <br /> 1r. Harrin ton warted to add that they had received the plan from Cape &Islands <br /> on July 20 , 2004. They have to approve, deny or request additional information. He <br /> didn't do that. He didn't review it in a timely-manner. So after 45 days it was <br /> presumed approved. Even at that point Mr. McNulty didn't come in here and say I <br /> arra ready for my permit to put the system in the ground. The plan was still approved <br /> as 1t sat. But, he still violated the time lines that were established for installation. The <br /> hoard could go back and set other conditions-based upon the violations to wine into <br /> compliance with regulation 7 . <br /> Mr. Ball asked if that was in the form of a motion. <br /> Mr. Santos stated that in that.ease did they want to revise the order to say that in <br /> receipt of the letter h had the opportunity to come before the board to explain to the <br /> hoard why construction had not begun. That he vas facing a fine of, 3 00.0 0 as of <br /> that date. <br /> 1 <br />
