3
•
I
Mr. McGrath stated that for instance the septic tank was grossly undersized. He did
not where the 7carne.from. It would appear to be a mathematical mistake that was
done by the previous owner. The issue then was, what really does the system have
the capacity for and it was no way near the 70 seats. There has been a mistake made.
The bottom line was that they had a chance when this changed ownership and
required him to put in the denitrification. An issue would have come up. But, they
ruled righty probably that the.condominium owned the waste water system. So the
condominium is saying that they were not going to go over the,10,000 GPD so they
were going to tell them that they would not get over 58 seats. They might have 70
seats with the BOH. But, as far as they were concerned 58 was all they were going
to get. Otherwise they could never put the denitrification system at least for another
year. It took.about nine-months to get a groundwater discharge permit. They had put
there up against a deadline. Unless this got very quickly it was going to put them
over the six-month deadline. And, by the way there have also been changes in the
way the department ruled this. There were two common systems that had been used
for denitrification that have had their denitrification approval suspended. No matter
what, the department would have said that no matter what technology was here.
They would have uncovered this problem and it would have to be addressed. He
knew that the restaurant owners seem to think that with a different technology they
would not have this problem. But, according to the department they have problem
because.they had suspend the denitrification with the two common systems Haat were
available.
Mr. Harrington asked what two systems he was referring to.
Mr. McGrath stated that they were the Micro Fast and Bioclere. Both of them have
overused between 70 and 80 systems. The department was saying that make 50 work
and we'll let you startP uttin them in. So, lair. Hajjar was going to put in a system
that would keep lain under the 10,000 GPD.
Mr. Ball asked if they would break ground on Building'A fiat:
Mr. McGrath responded that he had tried to get therm to separate therm But, they
were saying that since there was risk of a groundwater discharge permit all three
have to he done at once.
i
Ms. Grady stated that she was confused over what he was saying to them. She re-
iterated that they would have to Dave 1 600 GPI] for the space that was presently
Giovannr's.
Mr. Harrington responded-that he was just saying that that would he a solution if that
property or one space did not go hack to a restaurant shoving 56 seats there. That
would give all the latitude to take care of the flow problems. Right now the board
had approved 70. If they had approved these plans they were saying that they could
only"have 58 seats. That went against what the hoard had already approved.
S
L
