Mr. Santos made notion to approve the request to appeal the decision. of the board . <br /> of health regarding 48 James Circle and the application for the septic loan program. <br /> He felt that due to the extenuating circumstance noted in the letter from the Baders <br /> this warranted the approval. Ms. Grady se onded.the motion. Motion passed. <br /> APPOINTMENT: Michael Grot ke P.E. — 86 Summersea Road <br /> IVIS. Grady noted that although Mr. Grotzke stated that he was not going to be <br /> present at the meeting. They could possibly review it anyways. <br /> Mr. Harrington stated that the board had continued this from the last meeting <br /> basically because new information was brought to their attention the.sane day as the <br /> meeting. He had no problem with the submittal of the application. He had already <br /> reviewed it. But, the hoard opted to continue the agenda item. The request was for a <br /> one-bedroom dwelling. The issues here were the variances to the coastal hank and <br /> wetlands. The property was located in a Zone H. The original application called for <br /> FAST system. However, the-FAST system had reached their limit as far as the use as <br /> a provisional approval a Zone H. So the technology had to be changed over to the <br /> Amphidrome. He had no problem with this system. He had reviewed it. The ultra- <br /> violet was added because of the distance to the coastal hank. The hone was <br /> essentially within 100' of the coastal bark. They were also waiting for the <br /> Conservation Commission to determine the resource area, which was the coastal <br /> bank. There was some question on that. That had since been done. He recommended <br /> approval. The DEP approval was necessary for the Amphidrome system under #. <br /> provisional approval. He recommended the approval of the variances as listed in Mr. <br /> Grotke's cover letter. He was not going to read it because it was a whole list of <br /> setbacks. An executed 0 &M contract, which would include total nitrogen sampling <br /> for the Amphidrome system would have to be done quarterly for two-years and it <br /> would include the.maintenance of the ultra violet light and sampling analysis <br /> quarterly for two-years for fecal coliforms. Those results would not exceed Zoo <br /> colonies per nil. A deed restriction would he required because it was less than three <br /> bedrooms. The deed restriction requirement was part of the provisional approval <br /> from the stale. He would also recommend staking,the property lines. <br /> Mr. Santos made a,notion to approve the following variances for 86 Summersea <br /> Toad: Setbacks. A variance is requested to allow the SAS to be installed 0.1 feet <br /> from the street property line in lieu of the required ten feet. Setbacks. A variance is <br /> requested to allow the reserve SAS to be installed 16.3 feet from the foundation wall <br /> in lieu of the required 20 feet. Setbacks. A variance is requested to allow the SAS to <br /> be installed seven feet from the westerly property line in lieu of the require ten-feet. <br /> Local Board of Health Regulation—Setbacks. A variance is requested to allow the <br /> SAS and reserve area to be installed 84 feet from the edge of the coastal wetlands in <br /> lieu of the required 100 feet. (The Amphidrome Process single-family denitrification <br /> unit with a UV light was provided to mitigate this variance). Setbacks. A variance is <br /> requested to allow the anoxic septic tank to be installed nine feet from the <br /> foundation wall in lieu of the required 10 feet. The BOH approved the'Title v design <br /> plans as varianeed with the following conditions: 1.. The specifications for the ultra- <br /> . <br /> 2. <br />
