Burton Caplan made a motion that for each dog sold, the Kelleys must provide a <br /> certificate of lige birth within 7 days of birth as well as a certificate of health from the <br /> DVM; that the number of dogs at the seashore fennels be reduced to no more than <br /> within 30 days and that the Pelleys file as a hobby breeder with the Town to bring the <br /> kennel into compliance with the BOH kennel regulation; that quarterly inspections of the <br /> kennel be conducted by an Animal Inspector for the next 18 months, and that if any <br /> violations occur, the kennel license willbe revoked. lalliope Egloff seconded the <br /> motion. All approved. <br /> 2. 7:30 PM—classy Nails— Nuisance complaint <br /> Glen Harrington commented that on receipt of a nuisance complaint from a customer, he <br /> conducted an inspection on 7103108 of the Classy rails Salon, located on Rt. 151. He <br /> noted that of the five manicurists on duty, only tw6 were licensed. soiled towels were <br /> observed at unattended manicure stations. The manicurists performing pedicures were <br /> not wearing gloves. Glen Harrington stated that two other anonymous complaints had <br /> been received, complaining about the shop's hygiene. A third customer complaint was <br /> registered against the shop, after a technician caused extensive bleeding. Glen <br /> Harrington stated that he ordered Mr. Ler N. Dlep to appear before the BOH on 7/23/08 <br /> for a show cause Hearing. Mr. Diep was not in attendance at the meeting. <br /> Nis. Kimberly Evon introduced herself to the Board, who stated that on 7/01108 she, <br /> accompanied by her seven-year--old daughter.Jaida, went to the classy Mails salon for a <br /> pedicure. Ms. Evon stated that minutes into the session the manicuhst performing her <br /> pedicure cut into her toe, causing it to bleed profusely. The manicurist then tried to stop <br /> the bleeding with her bare finger before applying a drop of an astringent that temporarily <br /> eased the pain. Ms. Evon stated that the pain became so intense that she fainted in the <br /> Salon. When she revived, .ibis. Egon asked the manicurist to quickly complete the <br /> pedicure quickly so she could leave. Nis. Evon paid $30 for the pedicure: and left the <br /> salon. The toe continued to bleed for several hours, so Ms. Evon decided to return to <br /> the salon to ask for a refund. rills. Eon stated that the shop owner, Mr. Le Diep, <br /> insisted on removing the polish before returning her$ o payment. <br /> Burton Kaplan made a motion that Mr. Le Diep must post the cosmetology licenses of all <br /> technicians; that all technicians must receive CPR training; that all manicurists must <br /> gear gloves; that the Salon hire a linea service; that a contingency safety plan be put in <br /> place, including a sterilization process; and that i s s must be on site If the above <br /> sanitary codes are not met within 30 days, a fine of$ 00 per day will commence. <br /> Calliope Egloff seconded the motion. All approved. <br /> Luny Burton stated that the town does not oversee nail salons; it is the responsibility of <br /> the state. Neither the state nor the town can alone close a salon, but they could as <br /> joint effort. However, the town does have the right to adopt its own rules and regulations <br /> for salons. <br /> P —Lakeside Estates Requested Hearing with Counsel <br /> Glen Harrington stated that Mr. Matt Harney of lakeside Estates had phoned that <br /> afternoon to say that he was not going to be in attendance at the meeting tonight, and <br /> asked for a continuation of the hearing until the BOH meeting on 8/13/08. The Burd <br /> voted to deny the request, and to continue the $500 per day fine for noncompliance with <br /> BOH orders as outlined In their 2/14/08 order letter to No tt Haney.
