Board of Appeals Minutes -December 9, 1995 2 <br /> Edward F. & Stephanie Lanoue-Request a Variance from Section 174-32 of the Zoning <br /> By-laws for permission to construct a single-family dwelling on an unpaved road on <br /> property located in an R-3 zoning district on Amy Brown Road (Map 115 Block 3), <br /> Mashpee, MA, <br /> Members sitting: Edward M. Govoni, James E, Regan III and Robert G, Nelson <br /> Ms, Barbara Frappier of Wm. M. Warwick & Associates represented the applicants, She <br /> stated that the subject lot is one of several lots fronting on the unpaved portion of Amy <br /> Brown Road. She also stated that, even though this is an unpaved road, the Planning <br /> Board and the Town Engineer approved the subdivision. <br /> No comments were received from abutters. <br /> Mr. Regan moved to grant the Variance, subject to criteria 1 -4 and the fact that the road <br /> has Planning Board and Town Engineer approval. <br /> David E. & Joan L Barnes-Request a Special Permit under Section 174-25.1.9 of the <br /> Zoning By-laws for the construction of a pier, ramp and float in Popponesset Creek on <br /> property located in an R-3 zoning district at 3 Bight Circle (Map 106 Block 12), <br /> Mashpee, MA, <br /> Members sitting: James E. Regan, Robert G. Nelson and Richard T, Guerrera. Mr, <br /> Govoni stepped down. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicants and stated <br /> that in 1990 the Conservation Commission, Zoning Board of Appeals, State and Federal <br /> agencies approved the project. However,the Conservation Commission order of <br /> conditions expired, making it necessary for the applicants to reapply for a Special Permit. <br /> The Conservation Commission issued a new order of conditions two years ago. Mr. <br /> Slavinsky informed the Board that the proposed dock is 45 feet,well under the 70-foot <br /> limit. The applicants own a boat that will draw a three-foot draft. <br /> Mr. Govoni read a letter from the Harbormaster requesting that the"dock be shortened in, <br /> so that the back of the float is at the two foot contour of the depth. The float size should <br /> be reduced to 8&16 not 8&24." <br /> Deborah Bisson, an abutter, expressed concerns with visibility being reduced even further <br /> with the placement of the proposed dock and large boats in the area, <br /> Joan Hughes, a real estate broker involved in the sale ofthe'subject property, indicated <br /> that if the size of the dock is cut back, the sale won'tgo through. <br /> i, <br /> No other comments were received from abutters, <br /> F <br /> i= <br /> I <br /> i <br /> i <br />
