Board of Appeals Minutes—October 28, 1998 3 <br /> • Lot 12C will combine a portion of Lot 37 and Lot 38 and will consist of <br /> 25,314 square feet with frontage of 125,99 square feet, <br /> • Subject to ensuring the road in front of the lot is passable with a minimum of <br /> 14-foot width and 13.5 foot height clearance. <br /> • Subject to findings 1,3,4,5,6,8 for vacant lots <br /> • Four nonconforming lots will be combined into three buildable lots with <br /> frontages of over 100 square feet and areas of one-half acre. <br /> • The lots will be larger than others in the subdivision will be. <br /> • Owner has paid taxes on these lots since 1966. <br /> • Financial hardship exists for applicant if relief is not granted. <br /> Mr. Nelson seconded:. All agreed. <br /> Kevin & Marilyn J. Radford - Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the sideline setback requirements to allow for <br /> construction of an attached garage to property located in an R-3 zoning district at 41 Surf <br /> Drive(Map 103 Block 34),Mashpee, MA. <br /> Members sitting: Edward M. Govoni, James E. Regan IIT and Robert G. Nelson, <br /> Mr. Shawn Gilfoy, the builder for the project, and Mrs. Radford, the owner, represented <br /> the application. Mr. Gilfoy submitted revised plans for the construction of an attached <br /> one-car garage, indicating that the topography(a big gully)of the lot determines the <br /> placement of the garage. He also stated that the other houses in the area have garages and <br /> any new homes constructed in that area now require a garage. He said that the owner <br /> r plans to landscape the area. <br /> Mr. Govoni read a letter from Mr. &Mrs. Robert Connolly, owners of the vacant lot <br /> abutting the subject property, in opposition to the project. Their son-in-law, Mr. Robert <br /> Benoit, who is not an abutter, called on the phone in opposition to the project. Mrs. Olive <br /> Granville, an abutter,wrote a letter in support of the proposed construction. Mr, Govoni <br /> 1' asked if the owner would consider reducing the size of the garage by two feet. Mrs. <br /> Radford prefers the garage to be 16 feet by 22 feet as she intends on using it for storage <br /> area as well. <br /> i <br /> Mr. Nelson, a resident of the area, was of the opinion that the addition of the garage is <br /> beneficial, not detrimental, to the neighborhood, <br /> is <br /> Mr. Robert Benoit expressed concern that the garage will be encroaching closer to his in- <br /> laws' vacant lot. <br /> f <br />
