Board of Appeals Minutes-August 27, 1997 2 <br /> Tuan Ha-Ngoc - requests a Special Permit under Section 174-2519 of the Zoning By- <br /> laws for the construction of a dock on Fells Pond on property located in an R-3 zoning <br /> district at 164 Fells Pond Road (Map 122,Block 202)Mashpee,MA. <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Engineer Michael Grotzke represented the applicant and presented revised plans for a <br /> smaller dock which were requested by the Conservation Commission. He explained that <br /> there are 14 similar docks in the area. Mr. Govoni said he wanted Conservation to verify <br /> the edge of the wetlands and said that the Harbormaster had no problems with the pians. <br /> Mr. Govoni read a letter in opposition from Andrew M. Olins. <br /> Peter Zentz of the Fells Pond Homeowners Association said he was opposed to the <br /> original length and did not know that the dock had been shortened to 15'. He expressed <br /> concern that the dock would be used by trespassers. He said he thought the dock should <br /> only be used for a small boat and not diving. Mr. Grotzke said the dock was to get access <br /> to the water. Mr. Govoni explained that the Board had no authority on trespass issues. <br /> Lois Ridge, a direct abutter, objected to the original length. She questioned the railing and <br /> Mr. Grotzke said this was required by code. Ms. Ridge said the new design was an <br /> improvement. <br /> Mr. Govoni moved to grant the Special Permit for the construction in accordance with <br /> revised plans with the condition that there be no railing on the float and ramp, He stated <br /> that the plans should be reviewed with Conservation for agreement on the edge of <br /> wetlands. The permit provides for the repair and maintenance in perpetuity. Ms. Hawver <br /> seconded. All agreed. <br /> Dunkin' Donuts -Members sitting: E. Govoni, J. Regan,M. Makunas <br /> Mr. Govoni moved to continue to September 10, 1997. Mr. Regan seconded. All agreed. <br /> Mr. Makunas asked for discussion on the study. Mr. Govoni explained that the Town has <br /> received three sealed bids and three proposals. He said a Special Meeting will be held <br /> Wednesday, September 3 at 4:00 P.M. to review the proposals. <br /> Luis A. Perez -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the front and rear setback requirements. The applicant requests a <br /> Variance of 4.9 feet to allow a front setback of 25.1 feet from Wheelhouse Lane and a <br /> Variance of 5 feet to allow a rear setback of 15 feet on property located in an R-3 zoning <br /> district at 13 Wheelhouse Lane (Map 120, Block 169)Mashpee, M.A. (Owner of record: <br /> Mark C.
