Acconcia - Requests a Special Permit under Sections <br /> 174- 17 and 174-63 of the Zoning By-laws for permission to expand a <br /> non-conforming structure with a deck addition in an R-3 zoning <br /> district on property located at 42 Elizabeth Island Road (Map 123, <br /> Block 139 ) Mashpee, MA. <br /> HenryA. Acconcia - Requests a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the lot coverage <br /> requirements in an R-3 zoning district on property located at 42 <br /> Elizabeth Island Road (Map 123, Block 139 ) Mashpee, MA. <br /> Members sitting : J . Friel , M. Makunas, E. Govoni <br /> Architect T. S . Streibert represented the applicant and presented <br /> plans for an enclosure of a porch and addition of a deck . Mr. <br /> Makunas questioned the previous lot coverage versus the proposed <br /> 25% . Mr. Streibert did not have this computation. <br /> Mr. Makunas asked if deck was elevated and Mr. Streibert said it <br /> was approximately one foot off of ground . Mr. Makunas said he had <br /> no problem with it since the deck is more of a patio. Mr. Friel <br /> said he considered lot coverage excessive . Mr. Streibert <br /> explained that the owners wanted use of land facing Dean ' s Pond . <br /> Mr. Hauck did some calculations on square feet and lot coverage <br /> and it was discovered there were discrepancies in the engineer' s <br /> figures and Mr. Makunas suggested the Board continue to the next <br /> hearing while figures were being checked . <br /> Frederic W. Blythe - Advisement from July 15, 1992 . <br /> Members sitting : J. Friel , M. Makunas, E. Govoni <br /> Attorney William Henchy stated that after the last meeting the <br /> Board had .indicated that they wished the applicant to confer with <br /> the adjacent abutter Mr. Reidy to discuss his concerns.. He said <br /> Mr. Blythe spoke with Mr. Reidy and Mr. Henchy spoke with Mr. <br /> Reidy ' s counsel and was asked that Mr. Blythe not build the dock <br /> immediately. Mr. Friel reviewed conflicting correspondence in the <br /> file from Mr. Reidy ' s attorneys and comments from the Harbormaster <br /> saying dock would not interfere with boating . <br /> Mr. Henchy said the applicant had downsized the dock and tried to <br /> meet the concerns of all and that Conservation and Shellfish have <br /> no problems . Myles McHugh, an abutter, said Mr. Reidy was still <br /> opposed to the dock and did not want anything there. Mr. Friel <br /> said Mr. Reidy could still get a dock over the marsh and that Mr. <br /> Blythe would not oppose a side-line variance if necessary. <br /> Mr. Henchy said that the original stipulation from Mr. Reidy when <br /> the lot was created included the right to have a pier. There was <br /> discussion of putting steps on the dock and Mr. Makunas said the <br /> elevation was only b" and did not need steps . He did not think <br /> the dock would interfere with traffic . <br />
