Board of Appeals January 0, 1992 2 . <br /> i" .1 Requests 6 Special Permit under Section <br /> 174-25 . 1 . 9 of the Zoning By- laws for an existing sonsonal dock <br /> on John ' s Pond in an R-5 zoning district on property located <br /> at 15 Cranberry Ave . ( Map 49, Blocks IA2 and IWO Mashpoo, <br /> MA . ( Owner of record : Alan D � and Charna Larkin ) . <br /> Members sitting : W . Hanrahan, M . Makunas , E . Govoni <br /> Engineer David Sanicki represented the applicant and oxplained <br /> that they had an Order. of Conditions from the Conservation <br /> Commission for a house addition and for the licensing of the <br /> dock . He said that waterways regulations now required <br /> licensing of docks on great ponds , Mr . Govoni confirmed that <br /> the dock had been 6t that location for several years . <br /> Mr . Govoni moved to grant the Special Permit , Mr . Makunas <br /> seconded . All agreed . <br /> Request a Special permit under. <br /> Section IV4 , 17 of the Zoning By- laws for permission to expand <br /> a non-conforming structure with the construction of a house <br /> addition and garage in an R-3 zoning district on property <br /> located at 9 Bosun ' s Lane ( Map 111 , Block 84 ) Mashpee, MA . <br /> Rgh Q r t o wLe e q u e s t a V a r i a n c e f r o m S o c t i o i i <br /> 174-31 of the Zoning By- laws for permission to vary the <br /> set-back and lot coverage requirements in an R-3 zoning <br /> distc <br /> rit on property located at 9 Bosun ' s Lane ( Map 111 , Block <br /> 04 ) Hashpoe, MA . <br /> Membors sitting : W . Hanrahan, M , Makunas, Z . Govoni. <br /> Mr . Bowe;:: represented the applicatLon and emplained that he <br /> had purchased the house in 1990 and underskood it was in a <br /> zero- lot line zoning area of New Seabury . He explained thot <br /> the passing of papers was delayed since bank had questioned <br /> the need for a variance . He said the recent engineering work <br /> has resulted in the information that the house is not in that <br /> area . He said permit was issued in 1986 . Mr . Hanrahan asked <br /> if expansion could be reduced . <br /> Mr . Bowes submitted a map of the area which Board questioned <br /> might be map showing the perimeter of the cluster zoning area . <br /> Mr . Makunas stated that the house was built in violation of. <br /> the by- laws and was not grandfathered since it was not built <br /> prior to zoning . Virginia Landry. a Mashpee resident in the <br /> audience, reviewed the map and thought it was the cluster <br /> zoning map . The Members of the Board suggested that the <br /> existing violations should be corrected in order to have a <br /> clear title . <br />
