Board of Appeals Minutes March 9 ,. 1994 30 <br /> Members sitting: M. Makunas, E. Govoni, C. Hawver <br /> Engineer Roger Michniewicz. represented the applicant and <br /> informed the board that the subject lot is bordering a <br /> vegetated wetland line, He said the Board of Health had <br /> approved a septic permit for a two-bedroom home and that the <br /> Conservation Commission had asked that the house be moved <br /> away- from the wetland. The resulting front setback would be <br /> o feet. <br /> Jeffrey Lenk, an abutter, said he has ars ancient way <br /> easement and was working with the owner of the property on <br /> an agreement and warted the Hoard to include a condition on <br /> the protection of the easement . Mr. makunas explained that <br /> .the Hoard could not make a non-zoning condition and that the <br /> easement was a civil matterw . <br /> William Jackson, an abutter, stated that the house is <br /> smaller than all of the houses in the area, cannot have a <br /> .awn and will be closer to the street . He suggested it <br /> might be better not to build. Tim Cline, an abutter across <br /> the street, was concerned that there was no lawn and only <br /> two bedrooms in an area of larger homes . He questioned what <br /> type of fill would be used. Mr. Nichniewicz said house had <br /> been designed to be 31 above the road. <br /> Craig weedon, the builder, said that the Conservation <br /> Commission had conditioned that the house have two bedrooms <br /> and no lawn. <br /> Mr . Govoni moved to take the petition under advisement . <br /> anter seconded. All agreed. Mr. Makunas said written <br /> testimony would be accepted and the matter will be on the <br /> agenda for April 13 , 1994 . Ms, Hawver suggested the builder <br /> review the house plans and landscaping with the abutters. <br /> Robert C, and Auta P . Hendler - Requests a special Permit <br /> under section 174- * 1 . 9 of the Zoning By-laws for <br /> permission to construct a pier, ramp and float in <br /> Popponeset Creek in an R-3 zoning district on property <br /> located at 156 Popponeset Island Road (Map 112, Took 1 ) <br /> Mashpee, MA, <br /> Members sitting: M, Makunas, E, Govoni, C, Iawver <br /> Attorney Kevin Kirrane represented the applicant and <br /> explained that Anthony Ferragamo, architect; Roger <br /> ichn ewic , Engineer; and Mario DiGregorio, Environmental <br /> Planner were present to answer questions . He explained that <br /> the proposed dock design had been changed to meet the <br /> requirements of the Conservation commission, Harbormaster <br /> and Shellfish warder.
