MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 28,2018 <br /> Mr. Kirrane said that the building will be a two story structure because the typography of <br /> the lot drops significantly from the rear lot line to the street. The rear of the building will <br /> be primarily garage space and will be a one story space. The proposal also includes to <br /> construct parking on the side and front of the building which the Board has the authority <br /> to grant based upon the appropriate section of the bylaw. This project is almost a mirror <br /> image of what the Board approved back in 2004. This project requires Special Permit relief <br /> not only for construction of the building but also for the proposed uses. In addition, this <br /> project was approved with the Site/Design Review Committee, and with recommended <br /> approval by the Zoning Board. <br /> Mr. Kirrane also applied for variance relief that is similar to the approval of the 2004 to the <br /> property at 759 Falmouth Road. The footnote 13 of the Zoning Bylaw calls for frontage of <br /> 600 ft., and this lot as shown on the plan only has 200 ft. of frontage. Mr. Kirrane <br /> commented that the wording should be corrected on this footnote 13 because it mentions <br /> 600 ft. of frontage required on Rte. 28 and Rte. 151,and he suggested it be changed to Rte. <br /> 28 or Rte, 151. He believes the Board has the discretion to make their own determination <br /> regarding the frontage on these routes. <br /> Mr. Bonvie commented that Charles Rowley submitted a quote for this project, and that <br /> the Board made a decision to secure engineering review for these commercial projects at <br /> previous meetings. <br /> Chairman Furbush read comments submitted by Evan Lehrer, Town Planner into the <br /> record. <br /> Mr. Furbush polled the Board for their comments and agreed that a variance would be <br /> required for this particular case. They believe the bylaw should be re-written. <br /> Mr.Mendoza will be working with the Town Planner to possibly revise the bylaw wording <br /> under Section 174-31, Footnote 13. <br /> Vice Chairman, Bill Blaisdell read the Conservation and Board of Health comments into <br /> the record. <br /> Associate Member, Sharon Sangeleer read the Inspection Department comments into the <br /> record. <br /> Mr. Furbush wanted to know who will be occupying the contractor bays. <br /> Mr. Mendoza said that any prospective applicants outside the use of the proposed <br /> contractor bays would require a re-filing with the Board. Inspections are required by the <br /> Building Department and Fire Department. <br /> Mr. Kirrane mentioned that there will be office space in the front. He provided the Board <br /> with a list of requirements under the Special Permit that can be conditioned if the Board <br /> grants relief. <br /> 3 <br />
