BOARD OF APPEALS Minutes - November 13, 1991 2 . <br /> James Circle Realty Trust : Has Appealed the Decision of the <br /> Town of Mashpee Building Inspector on the issuance of a <br /> building permit in an R-5 zoning district on property located <br /> at 181 James Circle ( Map 71 , Block 157 ) Mashpee, MA. (Owner <br /> of record : Joseph M . DeMartino, TR ) . <br /> Ms . Hawver announced that the Board did not have a quorum to <br /> hear this Appeal and she and Mr . Friel agreed to call a <br /> special meeting on December 4, 1991 . <br /> Michael Forde, President of the John ' s Pond Association, <br /> stated that there were some administrative matters on the <br /> original James Circle Decision which needed to be settled <br /> promptly because they were delaying a mortgage approval . <br /> Robert Mills, Attorney for James Circle Realty Trust, <br /> informed the Board that the original decision contained a <br /> restrictive covenant requiring owners to be members of the <br /> John ' s Pond Estates Association . Mr. Mills said that the <br /> John ' s Pond Association does not have any scheme of <br /> protective restrictions on record at the Registry of Deeds . <br /> This now creates a title defect on all 16 of those lots . He <br /> asked for a modification . Mr. Forde said he could understand <br /> the dilemma of the bank . <br /> Mr. Friel stated that the Board could administratively delete <br /> language but he and Ms . Hawver agreed that language could not <br /> be added . Mr. Friel moved to delete Condition ##2 from the <br /> Variances . Ms . Hawver seconded . <br /> Ms . Hawver stepped down and Mr. Makunas continued as acting <br /> Chairman. <br /> John Gonella - Requests a Special Permit under Section <br /> 174-25 .G . 9 of the Zoning By-laws for permission to operate a <br /> wholesale and storage business in an I- 1 zoning district on <br /> property located at 80 Echo Road ( Map 19, Block 5 ) Mashpee, <br /> MA . <br /> Members sitting : M. Makunas, J . Friel , E. Govoni <br /> Mr . Gonella stated that he has two potential tenants for the <br /> land -- one for boat storage and one for automobile storage . <br /> Mr. Friel explained that more information would be needed . <br /> Mr . Makunas said that the Water District needed additional <br /> information . He suggested Mr. Gonella meet with the Water <br /> District . Mr. Gonella presented lease forms drawn for a <br /> previous tenant . Mr. Makunas said the forms could be <br /> reviewed by the Water District . <br /> Mr. Friel moved to take the petition under advisement <br /> with the understanding that the applicant meet with the Water <br /> District . Mr. Govoni seconded . All agreed . <br />
